      I purchased a car from ************ on 8/6/23. Paid with a check. Prior to delivery the car developed a problem that dealerships owner **** stated would be taken care of prior to delivery. As of 11/6/23 delivery has not taken place and the dealership has not accepted my phone calls and after many messages refuses to return my call about the delivery date for this car.

      We are sorry for the miscommunication happened here. 

      first and most important, We have never cleared you check, so we have never collected any payment from you (your check can be collected any time)

      The reason for that is that we did not want to give you a lemon car. we tried to fix the engine on the car but it did not work out. We are open to sell cars, and that's how we make our profit, but at the same time we want to make sure that our customers are always happy with their purchase. In your case the car would never make you happy and that's why we did not deliver it to you and we have voided the sale and did not collect the payment.

       I am rejecting this response because:
      The business can mail my check and any other pertinent documents back to me at the address on file and I will consider this complaint resolved.

      I traded in my 2008 Nissan Altima for a 2009 BMW series 3, within two business days I had to return the vehicle due to major mechanical issues that were obviously hidden by the dealership as the engine light was not on, however the car sounded like it was going to fail. Research showed the car had a manufactured recall on an engine part that had no even been made to fix yet, I lost money and had to “trade that first vehicle” for yet another of their vehicles. Approx 3 weeks after obtaining that new vehicle (another BMW 2011 5 series) as I was driving to my nursing program I heard a weird noise when my foot would leave the accelerator shortly after the engine light came on, according to research the car needed immediate intervention as possible loss of control of the vehicle along with fire were imminent. I as well as my husband tried to contact WinWin only to have them screen our phone calls and not answer their business phone to take our phone call.

      We do our best to inspect every car before selling it, and we follow California State law while doing our due delegates. 
      California State Law also gives the right to used car buyers to inspect the car before buying it, either by themselves, or by a professional mechanic they may choose. 

      California laws, when it comes to buying a used car, also does not allow a cool off period. and the customer sign a disclosure when buying the car acknowledging  all that laws and regulations. 

      In a respond to Heather ****** case:

      First Heather ****** was not in our data, but here husband Mr Chad ****** is the customer,.

      Mrs ****** called a few days after she purchased the car (All calls are recorded), and mentioned that she loves the car but she would prefer a white BMW in the Brown one she purchased. 

      As a curtesy, we agreed for the second time to take back the car. and like the first time she replaced the car we did not charge them a penny over what they paid (Both signed contracts are available and can be presented if requested).

      Mrs ****** said that she did not received the title of the purchased car at that time, and we told her that we can't take back the car until you receive the title. and that was the last call between us until we heard about her complaint here at BBB.

      At no time, Mr and Mrs ****** mentioned anything related to any kind of issues in their car, rather they kept saying the car is great (Recorded Calls) but she does not like the color.  

      Although, by law, a used car dealership is not obligated to replace or return a sold car no matter what the reason is, we replaced the first car for Mr and Mrs Fisher, and we show them our willing to replace the second one for them. 

      After more than 30 days from selling the car, and after many unsuccessful attempts to get in touch with Mr and Mrs ****** during the last few days (Voicemail left and recorded), we as the seller strongly believe that we did everything we can to satisfy our customer.
