      We hired Omega Construction Company, owned by *****************, during May-August of 2023. We hired him to do about $40K worth of work into a house we moved into, and he did a terrible job. When he was repairing and painting the exterior, he took many short cuts (obviously to save his cost). He did not properly prep the exterior prior to paining. He failed to caulk the gap between the overlapping wood frames and just painted over it, which left it vulnerable to termite infestations. When we complained and had him redo it, he again did an inadequate job. When he installed the floors throughout the interior, several areas began expanding and lifting up against one another when the weather got hot. When we complained about it, he said h*** fix it by trimming the edges, but itll alter the pattern and look of the floor and obvious evidence of the repair. When we just had enough of his poor work and did not want him to work on our house, we tried to negotiate some kind of refund, but he wouldnt budge. The floor alone cost $6800, so we only asked for $3000 back. His counter offer was $2500, but he gets to take the floors back. This was unreasonable, so we declined his counter offer. We just want what is fair.

      I received a complaint about cracks on the front side of the house and we went there to repair cracks and paint it again and now it looks fine. I received a complaint about flooring about a month ago and I told them that we can fix it in one day and they asked me to replace whole flooring with new flooding materials even though existing flooring materials are still fine so I told them that we can fix the problem by cutting the edges on both sides and if there is problem we can take off all the flooring and install again and we can replace only the damaged flooring materials but they wanted to replace whole flooring with other company so I told them that I can pay $3000 and when they replace the flooring with other company I can take the existing floorng materials so we agreed with $3,000 but next day they changed the mind and told me to fix the flooring so I and  two of my guys went there to fix the flooring but they didn't like one of my guys and they didn't want us to come in and fix the problem so we left. Now the flooring must be fixed as soon as possible since it has been already one month but it is hard to work with them and they didn't cooperate with me properly I like to go fix the problem as soon as possible when they let me go in and fix the problem.

       I am rejecting this response because: With such poor workmanship in so many areas, we lost all confidence in this contractor.  It wasn't just a small area or two that needed work on the floor, but all throughout the house.  His wanting to trim the tiles would eventually affect the entire floor throughout.  This would affect the patterns of the tiles.  Additionally, it was a very cheap vinyl tiles he laid, which obviously was affected by the heat/cold.  Regarding the gaps he mentioned, most painters will fill the gap with caulk at least twice and then paint over it to prevent moisture or perhaps termites to get in, but he just simply painted over everything as is.  Again, with so many errors and poor quality of work, we felt it would not be wise to let him continue his work.  So, we tried to settle with him by asking for a partial refund, but when he said he'll make a partial reimbursement ($3000) with the condition that he will take back the vinyl tiles, we believed that was absolutely unreasonable.  If we hire someone new to fix his mistakes, it'll cost thousands of dollars for the labor (and/or material).  So, after he takes the flooring back, his reimbursement would be a fraction of $3000, which means he benefits more from our loss.  His audacity to take back the material was ridiculous (and with such cheap vinyl tiles).  When he said he returnd with the workers to fix the problem, he brought the same crew that made the mess to begin with.  Why would we want the same people to do the work again?  With this said, we are still willing to settle without further legal action, if he refunds/reimburse us $3000 without taking the flooring back.  (It should be noted that he never provided us a written contract from the beginning, which we requested on several occasions.  We also noticed that our payment checks were cashed out by someone other than his name, which we're suspecting may be related to his business tax reporting purposes.)  We are an older couple, and he seems to have taken advantage of us.  We have plenty of photos to prove our claim.  

      We just don't have any confidence in his workmanship, ethics and business practice.  We do not want him to work on our project anymore.  We believe our request for the partial refund is very reasonable.  We have even consulted several other contractors who agreed with our assessment.
