I purchased a vehicle from this dealership on 1/3/22. Everything went smoothly, with no complaints. DMV registered the car without issues and I received the plates within a few weeks. However, the problem arose within a couple of months when the dealership failed to deliver the title to the DMV. I started calling in March, texting numerous times a month, I called and visited DMV twice, as well as went back to the dealership in person a couple of times. The owner ***** has been giving me the round around for the past 7 months, telling me that the problem is with ************** not providing him a lien release for this car. I am not sure what is going on, what I do know is that the dealership has breached the sale contract by failing to perform according to the contract terms. My understanding is that the dealership must turn over the title to the vehicle no later than 15 business days after the dealership has received the full payment (Cal. Veh. Code § ************ The vehicle was paid in full on 1/3/22 and it has been exactly 7 months since, still waiting for a certificate of ownership. My next step is small claims court, under Cal. Veh. Code § ******* I am entitled to compensation along with the attorney fees, if this is not resolved within a week.
