      On 10/14/2022 ******* ******* and his wife came to measure my property as we are looking to build and ADU in our backyard, they are supposed draw up the blue prints for us. At the time ******* said it would take about 3 months to complete the blue prints, it has now been 9 months and the blue prints need to be revised according to the city of ******** and ******* ******* doesn't reply to my email. We have gotten excuse after excuse as to why he can't complete his work on a timely manner, I have text messages and emails that prove my above statement.

      Dear Better Business Bureau (BBB) Representative

      My name is ******* *******, owner and representative of PRISMA PLANS. I am referring to you regarding the setting by Mrs. ****** ****.

      With respect to the plans that I made for Mr. ***** ****, who called me and verbally hired me and with his authorization, I entered his property to make a recommendation about the project that they planned to carry out and that we finally reached an agreement to carry out a project for a second dettached unit "ADU" And that his contractor had previously requested me and that Mr. **** radically changed his mind with my recommendation. Said agreement which Mr. **** did and that after a few days Mr. **** called me outside at his address ***** ********* *** ********* ** ***** to sign a mutually agreed contract and it was then that his wife Ms. ****** **** was present and listened and together with her husband they read the contract and agreed with the terms of the contract and one of the terms was the terms of payments one was when signing the contract of $3,250.00 and the second and last payment would be made upon submitting the package of plans and calculations stamped and signed by the engineer and the design plans signed by me, ******* *******. The day we agreed to submit the plans to the planning department, Mr. **** did not appear in the city of ******** and I went to his home ***** ********* *** ********* ** *****, that's when Mr. **** answered one of several calls. and he asked me to leave the plans with his wife Mrs. ****** **** and that in the afternoon when he returned from work he would send me the second and last payment of $3,250.00 of which he did not comply according to the contract signed by ******. ***** and ****** **** they only sent me by zelle the amount of $1,500.00 payment that I made with the condition that when the corrections came out and before submitting the plans They would pay me the balance of $1,750.00 for a change of mind and also a change of mind, their allegation was that it had already taken me a long time and that they would not pay me until their plans were approved. In my contract I NEVER MENTIONED THE COMPLETION DATE OF THE PROJECT because it depends on many factors and many different people, companies and the city that also requires time to review the plans. My delay was for various reasons, one was because I had to send the plans to be corrected with 2 different engineering companies. I had an emergency, I had to leave the country for several weeks and Mr. **** knew that the reason was that my mother died in the city of Durango, Mexico, but Mr. **** continued to pressure me insult Intimidating me and threatening to attack my person, at that time I sent him an email to ask him that if he continued he would issue a restraining order. but due to my ethics and responsibility, I continued with my work, I submitted the corrections to the construction department online 05-29-2023 after they lost us plans on paper, later they notified Mr. **** and I received them by regular mail 07-17-2023. At no time have I refused to finish my work and I am in the best disposition to do it as soon as possible. I have no problem fulfilling my contract. At the same time, I ask for my right to have my balance owed of $1,750.00 paid before resubmitting the corrected plans for the second time.

      Ms. ******* se the attachments of copies of the contract, a payments received and the email that I sent to Mr. ***** and ****** ****. For the moment I say goodbye to you.

       I am rejecting this response because:
      On 10/14/22 when ******* and his wife came to measure our property all 4 of us where discussing the project and at 1st our idea was to build a garage but in talking to ******* and his wife we decided to change it to an ADU, this conversation took place on 10/14/22 and at the time he said it would take approximately 3 months to complete but he was going to rush it for us because of the person who referred ua to him, so I'm a little confused on his allegations that we made major changes to the project after the fact and that it was him and my husband only at the initial meeting, I have cameras surrounding my property and I can prove this with video if need be, at this point I'm not sure if he's getting us mixed up with someone else he has screwed over because I'm sure we are not the 1st ones.

      I am also attaching a copy of the recipient ******* sent me 2 months after the payment was made on 10/14/22 which shows we paid him $3300 instead of $3250 like he asked. I have proof that a payment of $1500 was made to ******* via zelle on 3/2/23. I'm bringing this up because we do not have a problem with making the payments, I can pay him the full amount but who or what guarantees me that he is going to complete his work when the amount has been paid full if he hasn't been able to do so up to now.

      the delay has always been on ******* part, the 1st time the blue prints were sent back to him was because he had the incorrect codes, if you do this for a living how can you not know the correct codes, I'm not sure if at this point he is doing things on purpose or is he really the incompetent.

      Please let me know if the BBB recommends we make the final payment to someone who obviously has problems keeping his word and doing his job.
