OUR STATEMENT OF THE ***** REGARDING THIS COMPLAINT

THE CLIENT ***************** CONTACTED AMPAC, **** OVER THE SECOND WEEK OF JANUARY 2024. SHE PROVIDED DOCUMENTS FROM THE *** BERNARDINO DEPARTMENT OF BUILDING AND SAFETY AND ENVIRONMENTAL HEALTH REQUESTING ENGINEERING FOR HER PROJECT IN JOSUA TREE, ***

WE PREPARED A PROPOSAL/CONTRACT FOR THE PERCOLATION INVESTIGATION AND ONE FOR THE ***** FOUNDATION INVESTIGATION, AS SHE WOULD NEED BOTH TO GET HER BUILDING PERMITS. THE PROPOSALS WERE DATED JANUARY 17, 2024. SHE HAD ALREADY SUBMITTED BUILDING PERMITS AND AMONG OTHER THINGS THESE TWO ENGINEERING REPORTS WERE LACKING IN HER SUBMITTAL.

ON APRIL 29,2024 ***************** AND A SECOND PARTY CAME TO OUR OFFICE IN ********* TO START HER ENGINEERING PROCESS. IT SHOULD BE NOTED THAT THE PERCOLATION INVESTIGATION IS PERFORMED BY AMPAC, **** AND THE FOUNDATION ***** INVESTIGATION IS PERFORMED BY WAC GEOTECHNICAL, **** BOTH COMPANIES ARE OWNED BY ***************************** AND ARE BASED OUT OF THE SAME OFFICE.

MY ASSISTANT ********************* AND MY ACCOUNTS MANAGER ***************************** EXPLAINED TO ***************** THAT THE PERCOLATION TEST ($1,950.00) WAS TYPICALLY PERFORMED AT THE SAME TIME AS THE FOUNDATION ***** REPORT ($1,950.00).

THE CLIENT INSISTED THAT SHE WOULD HAVE THE *** REPORT DONE FIRST AND PAID THE 50% RETAINER FEE AS REQUIRED. THE CLIENT REFUSED THE PROPOSAL FOR THE PERCOLATION TEST SAYING SHE FELT THAT THE COUNTY MAY NOT REQUIRE THE PERCOLATION TEST AND EVENTUALLY GETTING OUT OF HAVING IT DONE. THE ALTERNATE MATERIALS RESIDENTIAL FOUNDATION AND DESIGN REPORT WAS PERFORMED AND COMPLETED ON 5-28-24.

THE CLIENT PAID THE BALANCE $975.00 IN CASH ON 6-11-24. SHE WAS GIVEN THE REPORT VIA ELECTRONIC MAIL AS IS THE REQUIREMENT OF THE REGULATORY AGENCY INVOLVED ON THE SAME DATE. SEVERAL WEEKS THEREAFTER THE CLIENT CALLED AND ADVISED THAT THE COUNTY STILL NEEDS THE PERCOLATION REPORT WHICH SHE HAD PREVIOUSLY REFUSED. SHE TRIED TO SUBMIT PLANS WITH A SEPTIC SYSTEM DESIGN ON THEM THAT THIS OFFICE DID NOT PREPARE NOR WERE WE PAID TO PERFORM. THE REGULATORY AGENCY KNOWS AMPAC'S WORK AND REFUSED TO ACCEPT THAT PLAN.

IN SUMMATION, THE CONTRACT SIGNED AND THE REPORT PROVIDED WERE PAID FOR AND DELIVERED. IT IS A CORRECT REPORT AND THE CLIENT REQUESTED IT. NO MONIES ARE TO BE RETURNED AS THE WORK IS COMPLETE AND CORRECT. THIS OFFICE WILL NOT PERFORM ANY ADDITIONAL WORK FOR THIS CLIENT.

PLEASE SEE THE ATTACHED DOCUMENTS REFERRED TO IN THIS STATEMENT.

      RESPECTFULLY SUBMITTED,

we explained to the complaintant that she did need the percolation test. she refused to have it done first she chose the foundation and soils report first. this was her decision not ampacs.

we did not hear from the party until she was told by the regulatory agency that she still needed the percolation test.

ampac has done nothing wrong . with out a doubt this client is trying to take advantage of ampac. she had already received both proposals and knew *** had to provide both reports.

again, after 44 years of business, only the idiots call the bbb. that is why we are not members of the bureau.
