    To whom it may concern, Amara Homeowners' Association (***) alleged that the *************** arrived late, resulting in late fees totaling $449.10 being imposed on the Homeowner. Despite numerous requests made to the *** for evidence to confirm the date when the checks were received, such as postmarked stamps on the envelopes, the *** failed to provide the necessary proof.In contrast, the Homeowner presented his evidence utilizing his bank's Bill **** demonstrating that the payments had been deducted from his account on May 5, 2023, a full ten days before May 15, 2023, the end of the ***** *******It's essential to note that the Homeowner has consistently made these payments on time for the past 11 years, never once being late, with payments always being deducted from the Homeowner's account on the 5th or 6th of every month. Furthermore, it is highly likely that the payments were misplaced at the receiving institution, perhaps due to construction or unforeseen circumstances, and were subsequently found and deposited. That would be a reasonable explanation for the delay in payments, further questioning the ***'s position on late fees.But even assuming, for the sake of argument, that the payments did arrive late to the ***which is hard to believe based on the past 11 years of experiencehow does the *** expect Homeowners, per ***'s written rules, to ensure that payments arrive on time when *** allows checks to be mailed, especially when the receiving end is in a different state? Homeowners have no control once the checks are in the mail. Therefore, the Homeowner firmly believes that the evidence he has provided demonstrates that his payments were sent before the end of the ***** ******* However, they were credited to the *** account late due to postal delays or other reasons beyond his control. As a result, late fees should not be imposed.Sincerely,********************************* ************* *******************
