November 29, 2024: I received a debt collection notice from Nelson & Kennard regarding an alleged debt owed to ***********, N.A. The notice listed a dispute deadline of November 17, 2024, but I received it late because it was mailed to my old address.Debt Amount Discrepancy: The notice stated a balance of $2,685.09 after a $661.92 payment credit, with $0 in fees or interest.November 30, 2024: I emailed ******************************************************************************************************* requesting debt validation. I received no response.February 2-6, 2025: A process server aggressively attempted to serve me three times, unlawfully entering my secured apartment building. On February 6, I was served a lawsuit summons for the alleged debt.Address Issue: The collection notice was sent to my old address, but the lawsuit summons was served at my new address. I updated my address with the ***************** in May 2024, six months before Nelson & Kennard mailed the notice.February 6 & February 11, 2025: I resent my debt validation request to *******************************************************************************************************, CCing ********************************************************************************************************* and ************************************************************ received no response.February 12, 2025: I contacted the Denver County Court to file an answer. The court had no record of a case being filed.February *****, 2025: I called Nelson & Kennard multiple times and received no response.February 26, 2025: I received a second collection notice at my correct address. It listed a balance of $2,750.09, with a new $65 fee added since the November 2024 notice.February 27, 2025: I sent a final request via email demanding a response by March 4, 2025.March 2, 2025: Nelson & Kennard finally responded to my debt validation request. However, they improperly added a $65 personal service fee on February 11, 2025, despite no lawsuit ever being filed. Additionally, they failed to provide a contract or assignment agreement proving they have the legal authority to collect the debt.Business Response

I am rejecting Nelson & Kennards response because it contains false statements, omissions, and violations of debt collection laws, and they have not resolved my complaint. I have attached supporting documents demonstrating these violations, inconsistencies, and unresolved issues. I respectfully request that the BBB keep this complaint open until Nelson & Kennard provides a legitimate resolution.

I am rejecting Nelson & Kennards response because they have not fully resolved my complaint and continue to provide misleading and contradictory information regarding their handling of my debt. I have attached documentation outlining the persisting issues.
Until these issues are resolved, I request that this complaint remain open. Nelson & Kennard has failed to fully address my concerns, and I will escalate this matter further if necessary. Since Nelson & Kennard has failed to resolve this matter despite multiple formal complaints, I am evaluating my legal options to ensure compliance with FDCPA and **** regulations. If this matter is not fully addressed, I will be pursuing further legal remedies.

I had a *********** credit card that went into collections. I actually paid it off in a settlement with the company once but didn't keep the confirmation number so that's on me. But, they filed a court judgment saying I won't pay even though I've made multiple attempts by phone, leaving numerous messages, at their business meeting them know I want to pay and would pay the full amount. They refuse to answer directly or call me back so I can't pay. All I want is to pay the debt and get it off my credit record. I'll pay it in full.Business Response

Nelson & Kennard have filed a complaint & summons against me in ****************. The ***************** is Portfolio ************************ out *******, **. This ***************** has 15 branches in the *************, None one of there branches are licensed in the State of **********. This illegal and I don't know if the lawyer is aware of this. You can go to **** Consumer access and look it up. I can give you Revised Codes of Washington (RCW's). I know even the lawyer can get in trouble for representing the collection agency (debt buyer). I would like them to Cease and Desist all collections, including notifying the collection agency to do the same.Business Response

I had a debt in the amount of $3221.28 with ******************* that was purchased by Cavalry, SPV I, LLC on Sept.13, 2021. According to the Fair Debt Collection Practices ACT, it states that a debt collector MUST provide clear and accurate documentation outlining the details of the debt, including the original creditor, the amount owed, and any relevant supporting information. I NEVER received a written debt validation notice from Cavalry SPV, LLC. On July 6, ******************************************** court on July 6, 2023. I never responded for said summons because I had NO idea that Cavalry SPV I, LLC, a third party debt collection agency, had bought my debt from Home Depot(Citibank). I waited for an entire year to go to my court date of July 6, 2023 at 9:00am in ******************* Superior Court. When I arrived I went to Department 9 as was stated on my summons, the room had been changed. When I went to Department 4, the door was locked. I went to the civil desk & spoke to a *********** told me it was removed from the docket in December, 2022. I was NEVER notified by Cavalry & have not had one bit of communication from them except the summons.They have wasted my time, ruined my credit & caused major stress in my life. They have protocols they must be following! This is harassment!Business Response

I was served a court summons from Nelson and Kennard in June for a debt from ********** Credit. I have sent two faxes asking to contact me so we could hopefully settle. I feel Nelson and Kennard is ignoring me in hopes they can say my judgment goes into default. I am rejecting this response because:On June 28, 2023 I spoke to ******* at extension 188. I inquired on the validity and veracity of the amount and right to collect from me. ******* said my faxes sent on June 19, 2023 and June 22, 2023 in which I am inquiring how to resolve this matter had not been received. However I did receive confirmation that both faxes were successfully transmitted. ******* said his firm has the proper documentation to collect from me and would be sending me the documents to prove. I recently had a horrible experience with an advisor who works for this company to the point I wanted to file a complaint with BBB. The individual I worked with was rude and not understanding and as someone who is disabled this was/has been a horrible experience that I wouldn't wish on anyone. Their platform to pay bills/billing system is awful. They do whatever they can to not work with clients and are morally unethical and what is wrong with our society today (capitalism). I am in the process of getting disability and they refused to work with me and gave me a payment plan that I cannot afford causing further issues.Business Response

I am not in agreement with this company for not notifying me of the withdrawal of money from my bank account and also for not giving me the information about the debt for which I am being charged such a high amount.
