Government Action: BBB reports on known government actions involving business’ marketplace conduct::
    Case 1:23-cv-0900

The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

On April 14, 2023, Asknet, Inc. and affiliated company Nexway, Inc. and principals Victor Lezuitov and Casey Potenzone entered into a permanent injunction for a complaint brought against the defendants by the Department of Justice on behalf of the Federal Trade Commission (Case No. 1:23-cv-00900).

According to the complaint, it is alleged that as of August 2016, the defendants were in violation of the FTC Act and the Telemarketing Sales Rule (TSR), for processing credit card payments for foreign based clients who were involved with committing telemarketing fraud. According to court documents representatives processed credit card charges to consumers who were led to believe their computer had been infected and repairs were needed to remove a virus. In addition to the defendants knowing of the deceptive business practices of their clients, it is also alleged that the defendant engaged in “credit card laundering.”

The Federal Trade Commission and The Justice Department will collect $650,000 in consumer compensation from the defendants. The payment of $650,000 will result in the suspension of the total monetary judgment of $49.5 million granted by the court.

Got a charge on my ****** card at 2:08 AM from Asknet/Iobitsoft. As far as I know-- I have never had any business dealings with these folks, and by the looks of the reviews listed here-- these folks are scam artists...

Our records show that this was a renewal of the Advanced SystemCare 14 PRO (1 year subscription / 3 PCs). It looks like you purchased this subscription back in 2020 and it has been renewing since then. We can cancel/refund this renewal if you wish. Please advise if you would like us to proceed by replying to this email.

Well, this a business account with ******, and the card this was charged on was only in my possession for about 2 weeks at most, and the folks at ****** said the card info showed to NOT be on file with this vendor-- so it amazes me at how this charge came to exist. I specifically asked ****** if this was some kind of recurring charge, and they said the card info was NOT on file with this vendor. We may have had an employee sometime in the past who signed up for this, but it appears as if they would have had to have access to my credit card in order to do that-- and especially since this card was virtually new makes me question how this could be? Bottom line, I had no way to contact anyone to dig into this-- so I went the route of cancelling my card, and disputing the charge, which was not really what I wanted to do-- but I could see no other avenue to get what I considered a non valid charge stopped.
