    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On August 17, 2022, Instacart agreed to settle an investigation brought against the company by the Attorney General of The District of Columbia (Case# 2020 CA 003777B). 

    The investigation stemmed from a 2020 lawsuit that alleged that from 2016 until 2018 consumers  believed that “service fees” charged on orders were tips that went directly to delivery workers. Instead, the fees went to Instacart, that the company used to subsidize operating expenses. It was also alleged that the company failed to pay the required sales tax.

    Without any admission of wrongdoing Instacart has agreed to pay $1.8 million to the District of Columbia to resolve consumer protection claims that may be used to provide restitution to affected delivery workers and consumers. Instacart also agrees to release $739,057 in disputed tax payments. Instacart has also agreed to comply with District law, to not deceive consumers, and ensure that it will not display fees or tips on its platform in a misleading manner.

    I made a transaction with Instacart on July 22nd in which my items were reported delivered but never were. I watched on the *** myself as the driver stopped in an area a little ways away from the house and then turned around so I messaged her and asked if she found the house okay. She told me that she did but I told her that I couldn't find the items to which she told me that she checked the address twice before cutting contact. I immediately reported this issue and filed a complaint ticket which I received a response the following date simply stating that they "maintained our decision to not offer a refund, credit, or redelivery" with no further explanation. I decided to call the customer service number and spoke to a woman who told me that the reason my refund was denied was because of the photo that the driver had provided them. She also told me that the driver's account had been flagged because she didn't provide me with the photo when I expressed concern. Seeing as she apparently was blocked from viewing this photo, I emailed a response to the previous resolution asking for access to the photo to which I did not receive a reply. Finally, I spoke once more to another customer service agent on the phone who confirmed that according to the *** tracking, the driver had not made it to the destination as I suspected but still couldn't help me with anything more. The transaction was only worth $40 or so, but I think the principle of the matter is the most important and I have felt like no one in that company is willing or able to help me. Every service that they have available for you to speak with in real time has no real power to do anything to resolve your situation and it comes off as disingenuous. I feel stuck in this situation and I hope that there is a resolution to be found,

    They charged me a yearly membership fee when I was on the monthly plan and they pulled the money illegally a day before payment was due. I got it refunded but I shouldn't have $100 tied up in pthe refund process for 5-10 business days when they had zero right to pull that money to begin with. The government needs to step in again. Instacart is making their own rules and laws and needs to be stopped.
