Without any admission of wrongdoing on September 6, 2023, 1 Health (formerly Vitagene) entered into an consent agreement (DOCKET NO. C-4798) brought by the Federal Trade Commission (FTC).
The complaint filed by the FTC in June 2023 states 1 Health deceived consumers about its privacy and security practices. 1 Health was accused of storing consumers health and personal information rather than removing the information from the business servers as requested. The FTC also states the company expanded the types of third parties that it shared consumers data with without notifying the consumers and obtaining their consent.
As part of the settlement 1 Health will pay $75,000 which will be used to refund consumers along with instructing third party contract laboratories to destroy consumer DNA samples that have been retained more than 180 days. In addition, 1 Health is prohibited from sharing health data with third parties without consumer consent and implementing a security program that addresses the failure brought against the company.Consumers who have questions about their payment should contact the refund administrator, Simpluris, at 1-888-427-9238 or visit the FTC website to view frequently asked questions about the refund process.
