      ******************** together with Luxury Kitchens owned and operated by the same people took 100% of our money for all materials including the cabinets (78K), slabs, sink, appliances (13K) and flooring and will not return our money. At this point we are trying to recover $150,000 of the $192,000 we paid and they cashed at Luxury kitchens ***************. This was brought to our attention by the **** and we found the ** code IT IS AGAINST THE LAW FOR A CONTRACTOR TO COLLECT PAYMENT FOR WORK NOT YET COMPLETED, OR FOR MATERIALS NOT YET DELIVERED. HOWEVER, A CONTRACTOR MAY REQUIRE A DOWNPAYMENT." ********** Code, Business and Professions Code - BPC § 7159 Their crew provided horrible work on the beginning of our kitchen remodel. They used a 15 year old to put up framing with only one other person and they told us that the header was warped and it was not secured properly and would need to be redone. They never did. We found a new unfinished electrical outlet behind sheetrock installed backwards which could have caused a fire down the road had we not stopped doing business with them. We are constantly finding more issues with their work including a plumbing code violation where the pipe is 47" from the T. We want to avoid court but are in the process of working with one that said we have a very good case

      Business Response /* (1000, 5, 2022/10/28) */ *********** and ************** (case number *******) have made false claims against Luxury Kitchens, a retail store. The have ordered appliances, tile, slabs, sink,faucet, window, cabinets and flooring. In the amount of $102,476.40. The slabs are at*********** available for pick up at*********** where they are stored in their warehouse. Hood, dishwasher(not paid for), tile, flooring, sink, faucet, and window are in Luxury Kitchen's warehouse per ******** and ****'s request to store for them. Please see **************'s complaint #*******. These items are available for pick up. Cabinets will be ready for pick up next week per our agreement. ******** was notified of this on 10/18/22 at 10:00am when she was at the store and again via email on 10/20/22. Consumer Response /* (3000, 7, 2022/11/02) */ (The consumer indicated he/she DID NOT accept the response from the business.) The hood was paid for from Invoice **** in the amount of $1719.00+ tax see attached. Contract from ******** reflects oven cost of $9,819.00 but was charged $10,849.00 also paid in full on check #**** on 6/1/2022. Total invoice # 1041 amount $13,746.25 See attached We did not request to store any products. This was the coordination of ******** *** to have materials ready for install according to a project timeline which was never shared with us even after many requests. As per the termination notice of the project on 9/29/2022, the supplies will no longer fit into our design and the new contractor will not be able to warranty any installation of these unseen products which were all paid for in the very beginning in May. Upon selecting the slabs, we were told that Luxury Kitchens, ************* said that we were not allowed to pay for the slabs. We paid invoice 1037 to Luxury Kitchens $7235.99 on 5/24/22 on check # ****. After the termination of the project, we called*********** and were told by both ****** and the manager **** that ***** would not release the slabs to us and that they could not let us have them even though we paid for them as they are on his account. At that time we moved forward and purchased new slabs. We also purchased equivalent cabinets - *****, for $19,782.20 rather than the $63,437.50 that we were billed for on invoice **** and paid on 6/15/2022 on check ****. See attached. We also paid $14,000 for an office area that was never designed - we have no idea what was ordered or why. Attached invoices were paid in full months prior to Luxury Kitchens ordering the products. Total fair refund amount requested is $120,590 which will cover the materials and the cost of rework from construction also paid for to Luxury Kitchens Business Response /* (4000, 9, 2022/11/14) */ Luxury Kitchens position has not changed. **** and ******** have been advised to pick up their purchased product.
