      1. Week of July 24, 2023 2. $4,250.00 3. Sand, prime and paint the front door-Sand prime and paint the front of the house Patch some stucco cracks, Sand prime and paint the Anderson sliding doors, Remove and repair cracked and missing grout shown. 4. Damage to deck from excessive power washing due to incorrect PSI, damage to Anderson sliding patio door windows due to excessive electric power sanding, damage to cement due to paint drops due to no drop cloths at front door and side of home, grout on driveway/sidewalk coming apart. 5. John ******** did return to view damage and offered for me to not pay for window washing and deck cleaning. i advised damages exceed the cost of the offer. He unfortunately became ill and response to resolving issues has become misleading and impossible with no communication to resolve issues. I am happy to have him or a representative to return to view damages and have this settled. Supporting documentation can be provided to assist with resolving claim. Can scan and send if needed.

      I have been serving satisfied customers in the Bay Area for over 35 years. I have never had a customer that is so convinced by her theories as to how everything happened with no proof just hearsay. I went to the customers house to provide an estimate on work that she wanted taking pictures. I noticed the back aging composite deck was fading and had dirt build up due to the years of outdoor weather conditions. I spoke to 3 composite deck expert and they said we applied the correct composite deck cleaning solution and power washed it off using a white nozzle which provides only a low pressure of water to rinse it off. I returned to the customers house to address her concerns and saw no damage only a clean deck. I also compared the before and after pictures only seeing a clean lighter deck. I also gave the customer a window cleaning estimate that she agreed to and told her that she had my employees work longer also cleaning her frames, tracks, and scraping off silicone that took longer but she feels it was included even if it was not in our written agreement refusing to pay anything? We painted selected exterior areas where she worked the price down and said we caused 2 window condensation areas on the sliding glass doors from the sanding which is not true and has no proof. Talking to the workers thy did cover the floors with a tarp and taped off areas as they always do and used a light sander only to remove the old paint to prep for primer and paint. I spoke to 3 window manufacturers and they said if we did cause that it would take months to develop not a week as she claims. Customer did pay for the painting job talking the price down again and said we did a great job and she was happy. I had a heart attack weeks after the work was completed and I looked at her concerns and nicely asked the customer to give me 4 months to recover and heal from my heart attack but she continued not to care continuing to call, text, and email me and harassing me in my weak condition to the point were my attorney said I have grounds for pain and suffering and harassment. She still has not payed me even after I told her we did nothing wrong.

      I am rejecting this response because:

      ANDERSOM PATIO DOOR

      I have proof the broken seal of the window glass window was caused by the electric power sanding. 

      This is a fact not a theory. Two licensed painting contractors have documented that the Anderson 

      Patio Window Doors are only to be hand sanded. I also have documentation from Anderson Windows and 

      Doors Co that an electric sander is never to be used on the window door frames.

      DECK

      Three licensed deck contractors have viewed the composite deck and all three deck contractors  

      stated the PSI and the  direction the power washer was used was done incorrectly.  Arturo, John's cleaning man,

      was having a difficult time setting up the power washer machine.

      WINDOW CLEANING

      When John ******** came to  my home on July 17, 2023, to collect payment for the deck power washing

      and window washing, my daughter and I pointed out to him the deck and window issues. He responded,

      “just do not pay for the window washing and power wash.”  I declined his offer and told him the damages exceed 

      the amount I owe him.  John did not oversee the work that was performed in my home and I have no idea

      what instructions he gave his workers.  One would expect when  an estimate to wash windows it would

      include a through cleaning of the windows, tracks, frames and  any dirt on the window.  There was no contract

      provided only an estimate.

      PAINTING

      John's painter, ******* ******  **** *********, did not use drop cloths on the aggregate walkway as a result there 

      are paint chips embedded into the aggregate.  Also, the concrete grouting Douglass Garcia did on the

      sidewalk and driveway is coming apart.  I have enclosed photos in the  email that I  will send. This issue was discovered


       after the original complaint was filed.


      CORRESPONDENCE

      In my correspondence with John ********* I was always considerate and wished him well.  John states on his invoices 

      that he is licensed, insured and bonded.  At one point, I did ask him to please have someone who would be 

      overseeing his business or his insurance company contact me and that did not happen.  I have all the emails and none 

      state that he requested for me to wait four months.  Originally, John asked  for one week and he would get back  to

      me. I gave him extra time and yet received no cooperation or response.
      .

      RESOULATION

      I sent John an email on October 30, 2023  with some suggestions on how to possibly resolve these issues and he

      never responded.  There was also an offer to have his advisors come to my home to view the issues .  I sent 

      the same email On November 11, 2023 and again there was no response.

      I will also forward an email along with the photos of the sidewalk and driveway grout.

      As a senior citizen in my eighties I feel that I have been falsely led on .

      I do hope we can come to a amicable resolution on all these issues.

      When I went out to address the customer issues, I was first shown the back deck were the customer asked what I saw wrong with the deck. I looked and said it looked lighter and clean. I was only pointed out that there were some small white dots.  I had to look very closely to notice them and said I don't know all I see is a clean deck. No other issues were brought up. now I see other pictures presented that were not brought up or did I see when I was there looks at the deck. Again, looking for any reason to say I damaged the deck and not to pay. Then I asked, what were the issues with the windows we washed? We only talked about washing the windows and not cleaning the tracks, frames, or scraping spots, which is an additional cost according to time spent. She demanded my workers to clean everything and when I invoiced here for the extra time spent, she said that it was part of the window washing. Clearly, we have an estimate showing only window washing in and out with no mention of the extras and she refused to pay. Then the issue of a few windows with condensation came up. I told her that it was not dirt and she asked why that was there and I said there can be many reasons why this happens. She throughout the idea that maybe when we were sanding the exterior window frame it happened, so I looked closely and saw the exterior frame is far away from the glass were there was no way our light sander would cause that. She has taken this theory and has been looking for ways to build on it only seeking answers that would help try to prove we caused it. At this point I told her she is looking for ways not to pay me and to just keep the money. Then I left. A short time after, I suffered a massive heart attack. I asked her that I would need many months for my heart to heal. I was hospitalized for almost a month, but she kept on calling me, texting me, and emailing me at the hospital. I again asked her to please give me time to heal then respond to you, but she continued to harass me over and over. When I got a little better, I was forced to reach out to my attorney for help. I found out that it can take at least a month and not days for the window condensation to appear with steam on a window once the seal inside is broken. This proves that we could not have caused this to happen. I ask that you please pay the overdue invoice so we can move on. Again, I still need time for my heart to heal and ask that you stop perusing your theory as to why and how things happened. I did my best for you and don't know why you are acting this way. Thank you!

      In response to your accusations, please take on the responsibilities of resolving these issues.  If you are not capable to assist, please have someone that you can designate and act on your behalf contact me.

       

      Again, I always wished you well and have never harassed you.  Please stop making these false accusations. I have emails to prove I have been nothing but kind and understanding.

       

      I have offered to have your advisors/workers come back to view the damages and to  fix them with no cooperation.

       

      When you came to my home on August 17, 2023 you agreed to contact the sales rep for Timber Tech decking company who was willing to work with you to possibily help solve the problem. You did not contact her.  The deck has been viewed by three licensed 



      deck contractors who all verified that the deck is damaged.  Solution: contact the rep to learn if there is anything that can be done to rectify the damage.

       

           On the Anderson Patio Door, the impact and vibration of the electric sander which Anderson Windows and Doors do not at any time  recommend be used caused the seal to break.  I have two licensed paint contractors estimates who stated in  their proposal to 

       

      only hand sand the Anderson Patio Doors.  To resolve this issue the glass needs to be replaced.  

       

      These are the reasons why  you were not paid for the window and deck cleaning. Again, when you came out On August 17,  2023 you offered  me to not pay for these services and I declined since my damage on the deck and window exceed what I owed you.

       

      On the painting and grout work, you were paid in full.  When I called, Douglas, the painter to notify him that there were paint chips all along the side of the walk way and in front of the entrance door. He came out tired to remove some of the chips and told me he 

       

      would be going to lunch and never returned.  I have a photo of the bucket he used to put some of the paint chips.

       

      The grout work he did on the sidewalk has come apart.  Resolution is to have Douglas return and clean up the remaining paint chips caused by his negligence of not using drop cloths which one of the worker acknowledged to my daughter were not used.  Also, 

      request Douglas to repair the concrete.

       

      Hopefully, you will contact the rep at Timber Tech and have your workers come out and do the necessary repairs.

      I hope everyone can now see the kind of person you are. You say you’re not harassing me but yet you keep doing so. I reject your none emergency theories of how everything that happened is my fault.  I responded to you and you keep rejecting it until you get your way. Again, I am recovering from a heart attack and my heart is very weak. I am taking a lot of medications and asked you several times to let me fully recover. I will not respond to this matter any further with the instructions of my doctor in order to fully recover.

      In response to your accusations, I am not harassing you when 

       

      I am the victim of the work that was preformed at my home by

       

      your employees. The issues have been verified by licensed contractors 

       

      who have viewed the damages and have confirmed that indeed the work

       

      was not properly preformed.

       

      Resolutions have been provided on how to rectify the damages and there has 

       

      not been any attempts to resolve the issues.  Given your health status, can you please provide a reasonable time frame as to when you plan 

       

      to resolve the issues and make restitution? 

       

      Once again, I wish to resolve this matter in a amicable matter.

      on 10/6/23 when I asked to pay for the work done because they were 2 hours early causing me to be late to another appointment I was presented with a handwritten piece of paper with what **** the owner wanted me to be charged hourly. At that point they were 1/2 done and were planning on charging me $225/ hour vs their published rate of. $120 for my size house with a permanent reusable coupon bringing the rate to $85. I complained and showed the tech the web site which I had also discussed with **** who had done my windows. and remembered . All he could say is he had lied but he worked for him. I told him I was reporting hi. for fraud.

      I called the client and explained the add she was referring to is still up on ****** search that is 10 years old. We both had an agreement that I will discount a future cleaning for her. She requested to take the old add down and that is what I am trying to do.
