Date of Contract: September 22, 2020 Amount Paid (1st Payment): $1,000. on 9/22/2020 Amount Paid (2nd payment): $7,000. on 10/29/2020 Business committed to provide the following: Site plan, elevations, foundation, floorplan, plumbing, electrical, roofing, framing, sections on details. Nature of dispute: Once we revised the last floor plans with elevations submitted to us from the Designer, we noticed that the initial plans requested before were not made. We asked the Designer to update plans with what we originally talked about. Designer then was charging extra, a total of $2,300.00 for him to move forward. All we received were the Floor, Elevation and Existing Site Plans from the Designer which was for the 1st payment. For the 2nd payment, he should have completed the rest of the plans with what the initial plans that we talked about and also submitted to the Planning Department and Ourselves. Since Designer did not want to move forward without us paying the extra $2,300, we decided to hire someone else to draw out our plans and had to start from scratch. Designer did not try to resolve the problem nor communicated anything else other than to charge an extra $2,300. for him to move forward. We were ignored after our last email on January 4, 2021 we explained to him again what our initial plans were. Since we heard no response, we decided not to move forward as well if Designer was charging more to continue. Desired resolution: It has been over a year since the last contact date with the business. However, I did not know until yesterday that we were able to file a complaint and possibly get a refund as we did not approve a change order after the initial floor plans. Therefore, we The desired resolution: A refund of 2nd payment for the amount of $7,000.
