      GN Roofing refuses to return my deposit without justification. In the beginning, the owner’s son stated my roofing job would be moved up the waiting list as soon as he received a 10% deposit. I paid the deposit but was not placed on the schedule until February. Due to the lengthy delay, I called other roofers and found a reputable one who I engaged to replace my roof in January. (This reputable roofer did not ask for a deposit and has already completed the job.) I would still be waiting for GN Roofing to begin my job in February. I have asked for my deposit to be returned and was told they were voiding the contract. However I was told yesterday that GN Roofing has decided to withhold $275 of my deposit. I have read GN’s contract and I can’t find any mention of fees that are justified. I believe I was scammed by this this roofing company’s offer to move me up their list if I paid a deposit. It appears that since I located an ethical company who did the work in a timely manner, GN Roofing decided to penalize me. (And just for the record, I chose to pay above the quote GN gave me so I could reduce the risk of GN’s time lapse of having additional rain damage to my property. Also, the company that did the actual work didn’t ask me for an upfront deposit.) Thank you for your consideration. Sincerely, K**** *********

      As the owner of the company ,I under the law of California and rules of the Contractors Board am obligated to give each client three days to cancel without any penalty or obligation. The contract was signed and canceled 26 business days resulting in a charge for the time serviced within the 26 days ($65.00 labor rate for 4 Hours and 30 Minutes, I am charging less), GN Roofing Contract Issuance, Permit Submittal & Cancelation, Date Scheduling & Response to Questions or Concerns to client. Normally a contract must not be canceled at any time after the three days are up, but I understood the reason and gave issuance to termination of the contract due to the roof being in the process of completion before my start date. As a contractor, by law, am allowed to charge 10% or less than $1000.00 for smaller contract amounts, also when the contract was submitted, the start date was on the very top when signed by the client.

      I am rejecting this response because: In his reply, M***** ****** provided no documentation from our contract that GN would charge any fees for services to void the contract. GN needs to provide proof that we were notified, in writing, that there would be fees for voiding the contract. I believe this is a scam to take advantage of the elderly as I’m 71 years old and believed part-owner, Jose P*****, when he told me, that due the rainy season, I would be unable to find a roofer sooner. However, l learned later that wasn’t true.


      Also, I dispute that this company spent time “servicing” my project. GN did no more than text me several times. I’m assuming that is the service provided to me. In the beginning, I did request addresses of other jobs his company had completed.  However, we were twice given information that sent us on wild goose chases to wrong addresses. When I asked to see a certain color roofing on a finished project, I was sent multiple pictures of the wrong color of roof. Furthermore, the contract was so vague that I decided to ask what supplies were going to be used on my particular project. I was told by Mr. P***** that it is not his company’s policy to disclose theses details in the contract to the buying customer.


      It’s apparent to me that the time that GN roofing claims they spent on my contract strictly relates to text messages in order to answer my reasonable questions relating to: the contract, shingle color, correcting incorrect information, and the possibility of installing rain gutters. The refusal to return the full $990.00 is unethical and punitive. There was no written, or verbal, disclosure that they would do such a thing.

      Thank you for your response. On the third page on the contract it clearly states the contract can be canceled "without penalty or obligation" if completed within three days, there is now a $275.00 penalty for what services were described. There in the contract is the penalty information that was initialed and signed by the client. My submittals for any documents are not free, my team works hard to provide issuance for all documentation needed prior to starting any project, we as a company are one of the top five in the county for our way of work. My son made an error on the address which he also responsibly took charge in and went back to confirm and submitted pictures of the property to clarify the address. He never sent wrong images, they were all correct, he submitted other photos of the same roof to provide different angle pictures from separate addresses (which is what I believe you mean by "wrong color of roof"). 

      Also, we had no idea of Mrs. M********'s age, as we do not discriminate on ethnicity, race, gender, religion or age, we simply treat everyone the same respect. I have a crew up north where Mr.P***** works with seniors because they do not trust in other contractors, they simply trust in Mr.P***** because he completes all jobs as needed in a timely manner with respect, even the state inspectors congratulate him for his work and have him preform State Projects which are Government Funded by California (Mr.P***** has his own license and has a partnership under my company, I am proud to have him on my team) Mr.P***** gave his reasons for not giving exact information and measurements, sometimes clients  want to give information to other contractors and book them instead (this happened after the three day contract signed), which Mrs.M******** didn't care for because thats exactly what happened. 

      A company is not made of just text messages, there are separate things that build it up to make it reputable from the rest. All documentation submitted to the client took time to prepare, a person who would want to rob from my company's time for performance would be an insult. The only free item we provide everyone with is the estimate and our honest recommendation. Maybe waiting for all estimates to arrive prior to accepting one would be the solution next time. I am sorry you feel this way about our services, just to clarify, this has only been the first time in my five years of contracting that I've had a problem with a client on such a level of difficulty. To us age is a number, everyone gets treated in a professional manner with respect.

      I am rejecting this response because:

      • As can be seen, the signed contract (refer to my attached copy) doesn’t contain references to any fees or penalties for severing the business arrangement prior to the start date. And the contract cannot be altered after it’s signed.
      • Missing from Mr. G***** is a mandated, detailed invoice of each service rendered for the 4.5 hours GN Roofing is trying to scam from me. (My requests for examples of a company’s work and shingle colors don’t count.)
      • Please note misrepresentation of the BBB A+ logo on GN Roofing’s Estimate Page (see attached). A clear violation of Business and Professions Code. I would think this falsehood alone should nullify the Estimate I was given.
      • Anyone can say they don’t mistreat the elderly, but I am currently being taken advantage of as a Senior Citizen. The Estimate and Contract forms used in my case were in violation of the contract standards in the state of California for Senior Citizens.

       

      I want to see the words on the page of the contract where it states that GN Roofing would charge me fees, or penalties, for ending our business relationship prior to work beginning at the site.

      As can be seen (on the document I am submitting to the BBB), the accredited BBB A+ logo is prominently presented at the bottom of the Estimate page. I later learned through the BBB website that GN Roofing is not accredited with the BBB (see copy of this webpage I’ve included), isn’t this clearly false representation?

       

      GN Roofing declares on their Web Page under the heading “About Us” that there is, “No Hidden Fees or Small Print”, yet here I am dealing with nonexistent print. Also of interest, is the fact that there is no evidence of “services” completed at the address pertaining to the contract. I believe under California Contractors License Law and Reference Book that the service charges Mr. G***** is attempting to bill me for, must be performed on the site and must be disclosed in writing which, he didn’t do. Since the roofing job was not begun at the house, GN Roofing has no grounds for withholding any of my deposit money.

       

      UPDATE: This afternoon, February 14, 2022, I received the attached letter from GN Roofing giving me 15 days to delete all false information. Since I haven’t given false information, GN Roofing has no reason to threaten me with a court filing.

      Furthermore, on page two of Mr. G***** ***** letter to me, he falsely claims he submitted, 

      “Building Permit Documentation to the City (Permit form was submitted and detained due to cancelation).”   

      This is not true. I personally went to the City Permit Department, and they stated GN Roofing did not submit any requests for a permit. (Even if GN Roofing had gone to the City, if you look at the contract, there is no mention of permits or charges for permits anywhere in the contract.)

       

      In closing, Mr. G***** ***** states, in his response (dated 2/8/22), “I under the law of California and rules of Contractors Board am obligated to give each client three days to cancel without any penalty or obligation.” It appears Mr. G***** *****, the owner, and president of GN Roofing, doesn’t know that the California Governor signed into law AB 2471 (became law on 01/01/21) which are new guidelines that GN Roofing has not implemented to protect senior citizens. As an example, the right to cancel is extended for persons 65 years of age or older. It is no longer 3 days as his contract states.
