I asked if he did concrete work; he said yes. He looked at where I need an aggregate-finish concrete walkway from my side yard to my driveway to eliminate tripping hazards. He used my tape measure, calculated 76 square feet, and called on 7/20 to quote $1,000 for the project.7/29 I texted him that I wanted to proceed with the walkway project; asked him to return my tape measure.8/2 I texted that I'd like the job done before 8/15.8/3 He texted his availability 8/12 or 8/13 and asked for $250 deposit for materials and a signed proposal.8/4 I texted that would be fine; met on 8/8, signed proposal for 8/12, and gave him a $250 check.8/10 Check cashed.8/11 At 8/21 p.m., *** texted that he couldn't work Friday as planned; he had to finish another job. I texted that *****, 8/16, would work.8/15 I texted him to verify 8/16 plan; he confirmed.8/16 He texted that he could not get concrete that day so would work Weds., 8/17. I texted him to set forms 8/16 and pour 8/17; he confirmed. At 5:49 p.m. he texted he was tired and would set forms in the morning. I said working until noon Weds., 8/17 was OK; then people were coming. He texted that was not possible--pick another day. This was the 4th time he was not available as promised, so I texted that this process was not working for me and asked him to return my $250 deposit and my tape measure (I asked for it several times; he has not returned it). He did not respond.8/17 I texted to ask when he would bring the tape and refund; I had expected him at 9, which was his original commitment to work.
