**** T. ***** DBA **** Tropics, LLC was contracted to install a complete irrigation system for a startup orchard operation in Fallbrook, CA. Once the irrigation has been installed and in operation, **** Tropics will plant 125 fruit trees as part of the scope of work. I have discovered that **** Tropics is NOT A License Contractor and has been performing contracting work for years. Upon inspection, the irrigation pipe was not installed to a standard irrigation depth (trench was only 4-5 inches deep) of a minimum of 12 inches deep, and improper joints, the joints have already about to cracked even before the well water is turn on with 110 PSI. When I request **** Tropics to make correction, the principal **** ***** got upset and render the job complete. At this point, only the main line was layout on the land, the irrigation is only 50% complete. Before the project even start it, **** Tropics demand 100% payment in full in the amount of $ 7575 and demanded 50% deposit for 125 trees in the amount of $8337.50. I have written a check in the amount of $15,912.50 check # 9011(combined total above). **** Tropics has committed "Conversion" of my funds by keeping my 50% tree deposit by walking away from the job and falsely taking the tree deposits for an allege additional work. None of the trees has been deliver or planted on the property. There was no change order provided in written or any verbal request to approve any additional work for the irrigation portion of the work. The contract clearing stated the irrigation scope of work cost $7575 in total and the tree deposit of 50% is $8337.50. Tree deposit is totally separate from the irrigation scope of work. **** Tropics has no right to keep the tree deposit by walking away from the job that is incomplete and now erroneously charging me $18,500 claiming additional work was done beyond the contracted amount of $7575. I will never approve more than double the cost. I was not aware extra work was done; nochangeorder
