      On 9/14/2023, I hired Blanca View *********************************************** LLC, *****************************************, ************, *********************** to complete carpentry on my home at ****************************************************************************************************************. The contract total was $130,356 and I paid $65,178 (50% deposit) in Sept 2023. I was told by *********************** that he would start the job in Oct 2023, then in Nov 2023, then Dec 2023, then in Jan 2024 and in Jan 2024, *********************** stated that he had a team and that the job would be completed by the end of Feb 2024. I have asked him to complete job or return the deposit on four separate occasions (Dec 2023, Jan 2024, and twice in Feb 2024). On 2/24/2024, no work has been done, ****** stated that the contract doesn't say when the job has to be completed. I asked again for a refund and he refused to comment other than to say he wanted to do the job. He had surgery in Feb 2024. In Dec 2023, i expressed a concern on if he could do the job and he said that is surgery would not be a problem. I know that he has not paid for the wood and he can not demonstrate how he spent the $65,178 on materials for my job. I simply want him to return the $65,178. I have told him four times that I want to cancel the contract and receive a refund. Each month he has a new reason for not working on the job.

      I have referred this to my attorney as a breach of contract. I had a crew do some work before the chinking company came in and installed exterior doors. The house had open ditches in the back and electrical had not been finished and inspected until December. Her husband did the insulation after the inspection and I installed the exterior door in January while I had a unary track infection and was advised by my Doctor not to lift anything heavy and have since had prostate surgery and will still be down for six weeks. I have told ***** that I can deliver the materials to cover the down payment. That offer still stands and dont feel that she would pay when the work is completed. I can deliver the material and let them find another contractor to install.

      I am rejecting this response because: ******'s statements are not the actual facts. I have attached emails and copies of text messages in which I expressed concerns about ****** being able to do the job. The attachments also documents when I asked for a refund and proof of ******'s use of the $65k to purchase supplies.  After not getting a specific response from ****** in 1/2024, I called around to lumber companies in ******, ** asking if they had a lumber supply for my property address. A order for wood was placed by ****** in September 2023 with Mountain Valley Lumber *************). I talked to the owner (****) and a worker (******) on January 29, 2024 and 1/30/2024. I was told that ****** placed the order in9/2023 and that there was a six week wait from when he placed the order. I was told that ****** never made a deposit or paid for the wood.  During one of my telephone conversations with **** on 1/29/2024 and 1/30/2024, I was informed that ****** had requested delivery of the wood in 1/2024 and that ****** had stated that he would pay for the wood in 30 days.  I was told by **** at *************** Lumber that he would not release the wood unless I personally guaranteed the payment of the wood. This concerned me because I had already paid ****** $65K, which should have covered the cause of wood and other supplies.  I was very concern because, as documented, I had asked ****** multiple times for support on what he had spent the $65k on.  (See Word Document for complete statement of rejection.)

      I have to reject Carols response as she was the one to breach contract. I had a crew go in and install windows and spray linseed oil on the outside side logs. I ordered the lumber in August and called in September to see if it was ready. ****** from *************** Lumber said he didnt get the order started yet. I also did more extra work for ***** and **** to excavate a hole for a propane tank and gas line and for fill sand from another contractor. As my proposal states billed on work completed I turned in a bill for exterior linseed oil install windows and the extra material and labor. ***** then said she wouldnt pay any more labor until the whole job was finished. That is the breach of contract as I cant any contractors to work without being paid as the are driving over one hundred miles per day and need payment at least every two weeks. I have several projects all over the valley at the same time and most of the materials are on credit. As for the last part in January I had some health issues and had prostate surgery February 29th and had a catheter since early January and orders from the Doctor not to work with heavy lifting but tried anyway on ***** and ***** doors. I ended up getting another infection and antibiotics. I had some help go up and install the exterior doors. **** started getting up and hat to leave the job site because of snow drifting on the road. The next week was a major storm with snow and wind. I couldnt get back up to the job site because of the driveway wasnt clear and not on my contract. I still had two more times of antibiotics before surgery and then another six weeks of recovery. I have never said I wouldnt finish the job. I informed ***** that she was in breach of contract. I can still get the materials and custom cabinets but will not deliver them until I receive the balance due as she only paid half down. All of the work I gave a proposal to was interior except for the deck. I cant get contractors to go work for her because of the fact she wont pay and didnt pay the previous contractor the payment she owed him. The trenches for the water line were still open and the deck could have been damaged and still comes down to not wanting to pay labor on work completed. **** was aware that I had health problems in January and I did have a contractor lined up until I told him about the payment and the other contractor she didnt pay. The cost of custom cabinets is ******* per linear foot not including countertops.

      Complaint #******** When I used 64915350E4B2F to respond to compliant #********. I made a typo in bullet #2: It should have stated "**** stated he had not received a payment on the wood. I paid for wood in Feb/2024." How do I correct this misstatement or delete it to provide and updated one? ***********************

      I am rejecting this response because:

      We disagree on the narrative and chorological order of events. Since we cannot agree on basic facts, this is my last time responding to BBB emails on this issue.

      1. Contract explicitly states to  Build outside deck for patio and out garage side door with Trex decking and treated floor joist

      2. In January 2024, I talked with ****** and **** (owner) from lumber company. **** stated he told ************** he could not have the wood on credit. I was told by **** that I had to personally grantee payment or make payment for the wood. I told him I had already paid ************** $65k at which **** stated he had received a payment on the wood. I paid for wood in Feb/2024.

      3. On 11/15/2023, at my expense, I wired ************** $7700 for his 11/14/2023 invoice for installing windows (he did not finish this work), spraying linseed oil on exterior log walls, backhoe work, and back fill sand. This included any additional work/service provided. He's paid in full for all services provided as of 2/24/2024.

      4. When ************** stated in Jan/Feb 2024 that the driveway was not cleared, I hired a company to plow the driveway after each snow fall. This was at my own personal expense. ************** was a no show.

      5. With the $65k, he should have been able to pay for any subcontractor invoices.

      6. In Jan 2024, after not seeing progress from the $65k,  finding out no payment was made on the wood, numerous missed start dates, he was informed that we would only pay for work performed.

      7. In Dec 2023, I expressed concern about his health and the weather and he said that neither were an issue.

      On 2/24/2024, he stated that "my contract doesn't state when I have to finish your project".
