*************************************, Specialty Chemicals and Equipment, as the authorized distributor, for BendPak, came to my residence garage, wrote a contract for a garage auto lift on Oct. 14, 2023. **************** advised he needed money to place the order. **************** accepted my personal check in the amount of $5,445.00 on Oct. 14, 2023. **************** stated it would take a couple months for delivery of the lift - approximately the week of Dec. 10th-15th, 2023. I called **************** mid Dec. 2023 to inquire about delivery of the lift. **************** advised his installer quit and it would be a bit longer before the lift could be installed in order to give him time to hire another installer. Not receiving any further installation time-table from ****************, and several weekly phone calls to him for updates, I called BendPak and they indeed verified that Mr. *************************** was an authorized distributor for BendPak. They also verified that they could not locate an order for a lift being placed from **************** or Specialty Chemicals and Equipment without an Order Number. Order Number missing from contract.Jan 23, 2024, by this time, I felt **************** was not being truthful about placing an order for the auto lift even though he had cashed my personal check immediately in Oct 2023. I called **************** on Jan 23, 2024 to request cancellation of the contract and requested a refund of my money due to his failure to complete the contract. **************** agreed to cancel the contract and return my money the next week. **************** failed to return many phone calls and basically has ignored any attempts to resolve this matter. Feb. 12, 2024 I sent a letter to **************** certified return receipt requested demanding return of my money. To date, Feb 29, 2024, I have not heard from **************** or received a refund of my money. I feel ****************' intent in this transaction was to ask for money to order the lift and never intended to fulfill his end of the contract.
