      I am writing to request your assistance. I have been receiving UNSOLICITED marketing emails from one *************************** at Allevia Home Care. I have asked the business REPEATEDLY to remove my email address from their server, and to QUIT contacting me. Allevia Home Care has insisted on violating my right to privacy and has blatantly refused to respect or honor my requests. I would appreciate your intervention regarding Allevia Home Care's obnoxious behavior.. Thank you for your assistance.

      Hello:

      Ms. *****'s email address appeared in a generic contact list we obtained, and we sent a single marketing email to that list.  When Ms. ***** replied, stating she was upset and did not want us to contact her, we sent her only one more email to apologize and let her know we removed her from our contacts.  She has not been contacted since by our organization, and we have no intention of ever contacting Ms. ***** again.

      We apologize for the delay in responding; the email used by the BBB to reach us was not our primary, so we had trouble logging in to read the complaint.

      Dear Sir/Madam~

       

      The Complainant hereby rejects the business' response and submits this rebuttal in regards to Allevia Home Cares 4/1/22 response.  The ongoing problem of Allevia Home Care disrespecting Complainants privacy rights started in January 2021.  At the time, Allevia sent an unsolicited post card with health related information that was addressed to Complainant and current resident.  By addressing the postcard to current resident, the  mail carrier is required by law to leave the mailing at Complainants former address, if, for example, she had moved across the hall or vacated the property.

      The post card touted the services that ********************** offers.  Someone (i.e. current resident) reading the postcard could determine that the Complainant has/have a serious medical condition(s) and *** be in need of their services.  Allevia Home Cares obnoxious behavior constitutes an unwarranted invasion of privacy.   Complainant was BEYOND IRRITATED because she did not consent to participate in Allevias marketing campaign.  At the very least, Allevia Home Care had the option to place the postcard in a sealed envelope and address it to the Complainant ONLY, or, leave her name off the mailing entirely.

      On 7/18/21, Complainant reached out to Allevia to communicate concerns about the post card.  When the business failed to respond, she followed up with another email on 7/23/21.  Exhibit 1.  On 7/26/21 Allevia responded that We did a mass mailing at the end of last year and the list of people came from a yellow pages list serve of people that *** need home health care services.  However, the yellow pages are a business directory consisting of firms and companies.  Allevia did offer to stop the unwanted communications.  Unfortunately, it was short lived.

      Complainant strongly disputes Allevia Home Cares recent assertion that her email address appeared in a generic contact list they obtained.  The attached evidence (Ex. 1) shows that Allevia got her email address when the Complainant contacted them in July 2021 about the unsolicited post card.

      In fact, on February 14, 2022, Allevia was at it again with their obnoxious conduct when they contacted Complainant via her email address instead of an unsolicited post card. Exhibit 2.

      Complainant promptly followed up (on 2/14/22) by sending an email to Allevia, with a request that they remove her email address from their records. Exhibit 3.  Complainant did NOT receive a response which prompted this BBB complaint. Allevia Home Care states that they sent her only one more email to apologize and let her know we removed her from our contacts.  Actually, the business is referring to their 7/26/21 response regarding the unsolicited post card

      Allevias claim that Complainant has not been contacted since by our organization is also UNTRUE.  Again, the evidence clearly demonstrates that they contacted the Complainant since their 7/26/21 email response, albeit in the form of an email communication instead of an unsolicited post card with revealing information.   Any reputable company worth their salt would  act more responsibly in their business practices by honoring a Do NOT Contact request the FIRST time they are notified of an individuals preferences.  Complainant hopes that BBBs intervention will put an end to this ANNOYANCE once and for all.  In the event, Allevia insists on  disrespecting Complainants privacy rights, either by U.S. mail or email, she will contact her lawyer.
