For the past 3-4 months, Terracina Apartments (SRG) has refused to enforce the lease provisions banning smoking on property (within 20 feet) and in the apartment/balconies. I live in Building 60, 4th floor, which has had a resident smoking intermittently. They have found evidence of said smoking, yet have done nothing about it. In fact, one of the staff tried to deny that anyone lived below me, where I thought that the smoke was originating. Yet it's funny that I have pictures of dog c*** and pee pads on the balcony of a supposed vacant apartment. The first incident occurred on December *****, which forced me to spend roughly $260 out of pocket to stay at a hotel (December 31-Jan. 2). The second separate incident began two nights ago (March 11, 2023). I reported it yesterday afternoon (March 12), but the smoking continues. I do notice that the smoke dissipates during the day, presumably when the resident or residents are elsewhere. I am currently paying roughly $2500/month in rent, which I have always paid on time, to live in a building where other residents violate the lease, despite ***************** health laws, and the leasing office attempts to gaslight me into believing that I am the problem. They have admitted that (a) smoking IS an issue; (b) that a maintenance man has ************** evidence of smoking on premises.I have attached the no-smoking addendum of the lease, their admission that smoking is an issue, and a demonstrated lack of lease enforcement. Since I am paying full rent despite having my quiet enjoyment violated multiple times without reprieve, I am requesting resolution by one or several of the following measures:1) A prorated reduction of my Jan and Mar 2023 rent, commensurate with the incidents and lease violations which they have NOT resolved;2) Allowing me to break the lease with NO PENALTIES with a 60-day notice upon a normal termination of the lease. 3) Censure of resident(s).4) Apology.
