June to Aug 1 2024 Paid business $3,000 for retainer fee in an ongoing divorce in disputed divorce. The services the law firm promised to help with are State Temporary Stipulations poorly negotiated by the previous attorney, who was also reported to the BBB regarding lost time with children. This is a basic service that all law firms are capable of.The lawyer was out of the office, made a request two weeks ago for adjustments to a temporary order, and requested the record of an unstable person in an attempt to ensure my children are in the best environment. There was no response, only to inform me of the bill and the need to terminate services over $554. There is no way this is acceptable business practice. A divorce is expensive, and I had to take out a loan to pay this firm, only to have them totally disrespect my time and limited finances.

In response to Mr.  ************************* complaint:

The $3,000 dollars Mr.  initially paid our firm is Marrison Family Laws initial retainer.  He was not charged any more than any other person who retains the firm.  **************** signed the attached fee agreement which clearly states the terms of our fees and our ability to withdraw for non-payment.  **************** was provided with numerous opportunities to pay his invoice.  Due to his failure to follow the fee agreement, we withdrew for non-payment.
Our office has been working towards getting **************** parenting time with his children, however Mother has not been willing to allow him to have make-up time.  The attorney was on vacation during one of the 2 weeks **************** refers to in his complaint, therefore a delay in his case did occur.  We are still in the process of negotiating and hope to get a satisfactory parenting plan in place for Mr. ****** soon.  Unfortunately we do not have any control over the response time or actions of Mother.
Due to Marrison Family Law fulfilling their obligations in representing **************** and his failure to fulfill his obligations, we will not be refunding Mr. ******.

I am rejecting this response because: If someone is paying an **************** for a service per the signed agreement. And that service is not provided, but justified as a standard procedure. How could you justify my time when the chief Attorney was away when I requested his expertise. I refuse to accept this because, the limit in finances for me means I would've appreciated more respect for the time paid for. The charges do not reflect the services provided.

      Sincerely,

      *************************

You retained Marrison Family Law on April16, 2024.  Of the over 120 day ************** has been your attorney, he has been out of the office for 7 of those days.  He does not have to have the approval of his clients to be out of the office.  Marrison Family Law has represented you ethically and fairly.  Additionally, we did not receive any complaints regarding our services until after the Motion to Withdraw was filed and your expectation that your attorney should work for free.  No refund will be provided.
