On December 12, 2022, ************************************ was performing work at **** Mount Woodmen Ct. (ref *************************************** permit ******). Foundation Professionals engaged Transmit Mix Concrete *** to deliver concrete to the work site. In the course of delivering the concrete Transit Mix deployed a full sized cement truck (est. 30 tons) onto the private driveway of the adjoining property, **** Mount Woodmen Ct., without permission. The private driveway is designed solely for passenger vehicle use. The cement truck discharged a quantity of oil on the driveway such that it ran down the driveway for approx. 40 feet. In addition, cement was spilled onto the driveway. Neither Transit Mix nor Foundation Professionals notified the owners of either property. Upon notice given by the owner of **** to Transit Mix on Dec. 15, cleanup efforts were attempted by both Transit Mix and Foundation Professionals. These efforts were not entirely successful. As a result, to correct the unsightly condition which exists as a result of the oil and cement spills, the driveway will need to be resurfaced. Proposals from asphalt driveway contractors are currently being solicited.Business response

I have spoken to our operation's team about this situation and I was told that "Streetsweeper was sent to the location, used dry sweep and available resources to clean the oil up, concrete issue was pump wash water and debris running down the hill, and contractor was aware and acknowledged it was his responsibility to take care of it or hold the pump company responsible."
When our driver arrives on the jobsite the contractor tells our driver where they want him/her to set up. The contractor is responsible for safe access and any damage our trucks do on private property. Unfortunately sometimes mechanical issues happen and as stated above we tried to clean up the oil spills the best we could. As far as the concrete spill, the contractor and their pump supplier were definitely responsible for that. It looks to me like the contractor is the one that is responsible

I do not accept the Holcim (formerly Transit Mix) claim that they have no responsibility for the damage they caused to my property. I suggest BBB encourage ****** and ************************************ reach an agreement between the two of them apportioning liability. I will not consider complaints against either of them resolved until I am made whole for the cost to repair the damage to my property. The estimates I have gotten are in the $5000-$6000 range.
