On August 18, 2022 we signed a contract for flat and fancy to remove an existing sidewalk and replace it with a new sidewalk on the west side of the house. In October of 2022, the new sidewalk was installed sloping towards the house, causing water to run into the foundation. This new sidewalk was against code, as verified by two independent concrete contractors. Engineers from GroundWorks have verified that the house has not settled since they installed helical pylons to stabilize the house. Weve asked that ******* come look at the workmanship, and he has not! Weve contacted an law firm to write a demand letter, which ******* at ***************************** has ignored. We would like to avoid going to court and want like to settle this with help of the BBB.. We would like ***************************** to pay for the removal of and the installation of a new sidewalk. This work is to be performed by a different contractor. Thank you for helping us settle this matter.Business response

This client has a leaking foundation from **** and the foundation leaks are not caused by our concrete. This has been explained repeatedly to the client. The client did hire a law firm and our law firm has responded to all letters sent.Initial Complaint

I hired Flat and Fancy based on good ratings to pour a concrete patio for me and could not be less satisfied with ********* response to my concerns. The surface of the concrete was so rough for a patio that my family cannot safely walk on it barefoot or play on it. We asked ******* to smooth it down some and his response was to tell me it was "perfect" and that he would only smooth it down for an extra charge. I will tell anyone to avoid this company because of the boss. The men worked hard and meant well, despite ******* approving the finish, but the surface was unacceptable to me and ******* says "the customer is not always right" when it comes to satisfaction. ******* was not at all willing to meet us in an agreeable way and ended our conversation with a demand for full payment by the end of the week. That's real great customer service for an unsatisfactory job!Business response

I was on site when this patio was finished. The broom finish is a tight broom. *** called and said the patio was unusable to bare feet and her grandkids could not stand to be on the patio. I came to the house to discover her grandson playing on the patio IN BARE FEET (jumping and running around on it). To us, this is a non-issue and we're not sure why she doesn't like her patio. It honestly did come out perfect. Photo attached to show her, her father and her grandson (in bare feet) standing on the patio while we discussed how her grandson could not stand to be on it in bare feet).Customer response

I am rejecting this response because:
Garrett continues to claim that the patio is perfect. His photo of my grandson in bare feet on the patio shows him standing on the part of the patio that is acceptable, which was finished before it began to rain. The part of the patio that is unacceptable is closer to the deck area and was left rough. My grandson did not walk on that part. **************; lack of concern for my satisfaction, demanding payment in full by the end of that week, shows that customers' concerns are only a bother to him. He has determined in his own mind that I am nothing but a bother. Two other contractors have looked at the work and agree that the part I'm unhappy about is genuinely unacceptable. My complaint stands. In the meantime, I'm very sure that **************; lack of interest in my satisfaction would only lead to a small claims battle, and I'm not up for that. I would not recommend this company to anyone.

*** did not add any new information. The patio has the same finish and consistency throughout. Again, I will stick to my photographic evidence that her claim is false. Also, she did submit payment in full which would not have been done if she truly disagreed. Since this project is paid in full and we have photographic evidence of the patio being used in bare feet, we still consider this a non-issue.Customer response

I am rejecting this response because: Garrett continues to disregard my verifiable dispute with his assessment of the "consistent" surface on the patio. His threats to "enforce the contract", which nowhere guarantees customer satisfaction, is the main reason that I paid. My credit us stellar and his disagreeable attitude was not worth a further battle. He simply did not care that his customer was unhappy with an inferior finished work.
