      My complaint is the business practice of Wood Design Landscaping in Cortez Colorado. October 2022 with no regard for following state law they recorded an invalid and unenforceable mechanics lien on my property over a dispute involving monthly lawn service from October 2021. This information about their business practice is important for prospective customers who check this bureau prior to hiring a contractor. According to Colorado state law if the Contractor fails to remove an invalid lien the property owner’s recourse is to obtain a court order for its removal.

      I understand the frustration you have regarding the service charge for landscape maintenance services. However, it was spelled out clearly on the Service contract that you signed April 7, 2021 that the maintenance services and all services included were prorated for the entire season with a minimum of 6 months paid in order to fulfill contractual obligations, and recover costs associated with services included but not charged individually.

      Upon review of your account, there were 5 monthly landscape maintenance fees paid for 2021, with a minimum of 6 months agreed on. Per your agreement, one remaining monthly service charge of $250, along with the cost of winterizing the sprinkler system of $65 is past due.

      Now the separate issue of replacement plants was resolved as soon as plants were available – and at that time, you assured ***** (owner of WDL) that you would pay your invoice in full when plants were replaced. However, you only paid for sprinkler activation of $65, which was again, a separate charge completely.

      When your payment did not reflect the proper amount that was due on your account, we gave you ample time and notice to resolve your debt. The lien on your property is valid and remaining in place until your debt is paid, or legal action is filed. Please consider this final notice of this issue.

      The fact of the matter entirely is that 6 months were agreed to as a minimum, 5 months were paid.

      I am rejecting this response because: 

       The business did not respond to the complaint issue regarding the placement of a mechanics lien on property contrary to Colorado state law. They have been provided a copy of the statute and regulations via certified mail and made no comment or reference to following the law and the validity of the lien, which is the issue of this complaint.
