    Government Action: BBB reports on known government actions involving business’ marketplace conduct:
    Settlement Agreement between the United States of America; DaVita Inc; and Relator Dennis Kogod

     

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

     

    On July 18, 2024, a Settlement Agreement ("Agreement") was entered into among the United States of America, acting through the United States Department of Justice and on behalf of the Office of Inspector General of the Department of Health and Human Services, (collectively, the "United States"); DaVita Inc. ("DaVita"); and Relator Dennis Kogod.

     

    The claims resolved by the settlement are allegations only. There has been no determination of liability.

     

    DaVita Inc., headquartered in Denver, Colorado, has agreed to pay $34,487,390 to resolve allegations that it violated the False Claims Act by paying kickbacks to induce referrals to DaVita Rx, a former subsidiary that provided pharmacy services for dialysis patients, and by paying kickbacks to nephrologists and vascular access physicians to induce the referral of patients to DaVita’s dialysis centers.

     

    The Anti-Kickback Statute prohibits anyone from offering or paying, directly or indirectly, any remuneration — which includes money or any other thing of value — to induce referrals of patients or of items or services covered by Medicare, Medicaid and other federally funded programs.

     

    The United States alleges that DaVita paid kickbacks to a competitor to induce referrals to DaVita Rx to serve as a “central fill pharmacy,” or prescription fulfillment provider, for that competitor’s Medicare patients’ prescriptions. In exchange, DaVita paid to acquire certain European dialysis clinics and agreed to extend a prior commitment to purchase dialysis products from the competitor. DaVita would not have paid the price that it did for these deals without the competitor’s commitment to refer its Medicare patients’ prescriptions to DaVita Rx in return.

     

    The United States further alleges that DaVita provided management services to vascular access centers owned by physicians in a position to refer patients to DaVita’s dialysis clinics. DaVita paid improper remuneration to these physician-owners in the form of uncollected management fees to induce referrals to DaVita’s dialysis centers.

     

    Finally, the United States alleges that DaVita paid improper remuneration to a large nephrology practice to induce referrals to DaVita’s dialysis clinics. DaVita gave the practice a right of refusal to staff the medical director position at any new dialysis center that opened near the nephrology practice and paid the practice $50,000 despite the practice’s decision not to staff the medical director position for those clinics. 

     

    The civil settlement includes the resolution of claims brought under the qui tam or whistleblower provisions of the False Claims Act by Dennis Kogod, a former Chief Operating Officer of DaVita Kidney Care. Under those provisions, a private party can file an action on behalf of the United States and receive a portion of any recovery. The qui tam case is captioned United States ex rel. Kogod v. DaVita, Inc., et al., No. 17-cv-02611-PAB (D. Colo.). Kogod will receive $6,370,000 of the proceeds from the settlement.

     

    The resolution obtained in this matter was the result of a coordinated effort between the Civil Division’s Commercial Litigation Branch, Fraud Section, and the U.S. Attorney’s Office for the District of Colorado with assistance from HHS-OIG.

     

    The investigation and resolution of this matter illustrates the government’s emphasis on combating health care fraud. One of the most powerful tools in this effort is the False Claims Act.       On Nov. 28, 2022, my husband and I entered into an agreement with DaVita Kidney Care for the ability to complete required dialysis treatments at home. Part of their contract includes reimbursement of any costs resulting from required home modifications. In order to support the dialysis machines, we needed a water and drain line installed in our home, which costed $775. I submitted the required documentation (an invoice for the work and proof of payment) to DaVita and waited. Over the last year, *** spent countless hours following up with DaVita on the status of the reimbursement. Their **************** agents have agreed we are entitled to the refund and keep assuring me a refund will be issued, but it still has not happened.A company of this size and that offers reimbursement in their signed contracts, should have a better process to ensure customers receive what theyre entitled to in a timely manner. It is unacceptable that its taken over a year for them to make good on this issue and is requiring third parties, like the Better Business Bureau, to get involved for it to be taken seriously.On a personal note that magnifies the situation, my husband passed earlier this month. His desire and intention was to receive this refund and repurpose it for an experience off of his bucket list. He was unable to accomplish this due to DaVitas prolonged and inefficient refund process. They truly do take advantage of people in their darkest hour.

      ******** Doesnt understand that the patients need and want to feel comfortable, We finally got someone thats for us and that understands us as patients and Davita Fired them we had the best security guard I cant spell his name but we call him Z he was their for us to make us feel safer and comfortable now its like he did more work then any other staff the secretary never speaks doesnt even look at us she never opens the door and always has her window closed as if were criminals and the social worker OMg she needs to go each time we speak to her she just responds in a ignorant manner and walks away one time an ambulance was on site and had to call her on the phone she spoke so rude to them that the medic had to give the phone to someone else she is very very horrible as a social worker she not very social at all she walks around the site saying My Mouth Is Vicious every day all day just so no one will ask her for help ,, We finally get someone that helps us makes sure were comfortable tells us when our rides are here he even sets up chairs outside just in case we want to sit and wait outside after treatment cause its always so freezing in the lobby he did his job very very well we heard he got fired because of lateness ours that is true he was late at time but what can u expect he worked everyday its just so sad that he had to go all of us here really liked him I wish he was here today he really makes this place feel better once I left my purse and couldnt find it anywhere I came back and he found it I was so relieved that nothing was missing I had 1500$ in my purse all still their I looked up at him and said with a smile The lord is gonna bless u for this he really was their for us and now we have nothing I really wish **** was back here cause he wouldnt have let him go we miss him around here its not the same at all We Always used to tell him that he should ask to become a patient coordinator cause he understood people WE MISS HIM
