In regards to complaint #******** that I submitted yesterday. It is now three (3) business days until the scheduled closing of the real estate transaction with ClearSale by HomeTrust. The contract has not been terminated and I cannot move forward. The closing of my new home is on 9/12/22, please help me resolve this.

While we do regret the stressful combination that a fire caused, we did our best to try to help you in an extreme circumstance. We did not advise you to pay off your home before closing at any time and we have no affiliation to the title company in respect to partnership or ownership, and their role is to ensure title is clear so that we can close on the home.  We did not ask them to do anything other than their standard title work on this property.  In our consultation with you, we did discuss that this was more complicated due to the fire damage, and that we still had to give you the Green ***** before proceeding to closing. Again, we do understand the undue stress and wish you the best in your sale of your home.

Clearsale by Home Owner (There number ************) continues to contact me via phone wanting to buy my house when I have told them no and to take my number off their list. My numbers (cell and home) are on the *** Do Not Call List. I have filed a complaint with the ***, and no resolution. I want them to STOP calling me and NEVER do it again.

      Business response

      Hello *******************,

We take the Do Not Call list very seriously, as people who have registered for the Do Not Call list have clearly stated their desire to not be bothered with unwanted phone calls.

There are two ways we scrub our data for the Do Not Call lists:

      1) We, like almost all other businesses who market to consumers, buy our lists from publicly available data sources.  These data sources - by law - have to scrub the lists we buy in order to remove any phone numbers on the Do Not Call list to maintain compliance with the Do Not Call list.  Otherwise they would get in big trouble with the government.

      2) We use an online phone system (it's a big company with thousands of clients) that - by law - will not allow us to call phone numbers on the Do Not Call list.  Again, the phone system company would get in big trouble with the government if they allowed any of their phone users to call Do Not Call list, so they do not even display any phone numbers on the Do Not Call list.

In spite of all of this, I have taken two actions:

      1) I directed my team to look for your phone number in all the lists, databases, and software programs we have. We did not find your phone number in any of our systems.  Since we do not even have your phone number, I do not know how we could have called you.

2). I have assigned **** a member of my team, to look in all our lists, databases, and software programs on a weekly basis for your phone number in case it has somehow slipped through.

When we talked on the phone today, and when I emailed you todya, I provided you my personal mobile phone number and my email.  Please contact me directly if you have any issues so I can personally be involved.

      Thank you,
      *********************, President
