    On 12/31/2021, my house burned down in the ******** Fire. I hired Health ***** and Advantage Adaptive to do the debris removal. The contract was to remove the foundation and all the burned area within a certain radius of the home, dispose of the debris properly and test that the land was no longer toxic based on Boulder County regulations that were set. The contract states that the foundation would be removed and that piers greater that 3 feet would be left. In June of 2023, after a year and half of waiting for the county to decide the rules to rebuild i.e. Article 19, designing the replacement home to current code, permitting within Boulder County and the lengthy process of hiring a contractor we have begun construction. When we began moving dirt so that we could install concrete forms for our new foundation, we uncovered foundation from the old home that was never removed. In fact, the foundation had been marked with a red X by the excavators, left and covered with dirt. It was clearly noticed in multiple locations and deliberately covered with minimal dirt. Nothing was communicated to me that part of the foundation was going to be left or was this discussed. The contract clearly states removing the foundation. This an insurance claim and the debris had to be tested to prove it was no longer toxic and enough layers were removed, which according to ***** took 5 business days after he sent it. We then had to take photos to provide to insurance along with the lab results to issue payment which we expedited through the process and received on 4/29/2022 and then subsequently paid Health. He met me in ******* to pick up a check. We did not discuss any concerns with the debris removal or challenge. ***** issued me a lien release. In July of 2022, we received a Notice of Lien from Excavators that ***** had not paid them. ***** had never told me that he hired a subcontractor to do the work. We asked ***** to pay the subcontractor immediately since we had paid him months prior in full and had a signed lien release from him. He did and Excavators did not file the lien on our property. In June 2023, I called ***** the day that the foundation that he did not remove was discovered and encouraged him to come out to see it and discuss it. He came out two days later. Two weeks later he meet with our GC and us to discuss the foundation that was left. He offered to pay $5,000 of bill which we expected to be $10,000 -$15,000. After a month of back and forth of emails, he now says that he will pay $5,000 and that his company is not "an environmental company". when I contacted him in March, he told me his company does do private debris removal the same as if we waited to do it with the county. He assured me that he was licensed with the county to handle such work when I first contacted him and assured me he was doing the debris removal for multiple homes affected by the ******** Fire.I am filling a complaint because my contract states we would remove the foundation of the home. We have asked ***** to pay the total bill that we incurred for the additional removal since he did not complete his contract. He is not willing to pay the total amount. In fact he told me to file another claim to my insurance company and ask them to pay for work we did not do. I would like your help to ensure business do not take advantage of homeowners.
