On 5/13/22 I signed a proposal for repairs to be done on my driveway, walkway, and porch.Shortly ****************** was signed, the work was completed. It seemed to be a job well done. ****** said for me to contact him if I had any issues, etc.In approx June '22, I noticed flaking on the driveway and contacted ****** immediately. He said he would come by and take pictures, etc. It took at least two more phone calls for him to stop by. No pictures were taken. He was here approx 5 min. He said he would take care of the problem. I contacted him several more times. He did make one appointment to come by, but he never showed. The summer was coming to an end and I did not attempt to contact him anymore. So, phone calls were made to him from approx June until Sept.I have a copy of the proposal if you need this.Business response

Good Afternoon BBB Representative:
I am *************************** the owner of Malibu Pools LLC. I went by ******'s house last fall when she said she had some flaking of the polyurethane we installed over her driveway. The product installed was recommended and purchased from ******************************* commercial division in ******. This product was highly recommended by *******************************. She had some minor flaking and I said we would take care of it and we will. I just was busy with a pool build at the time that I finished on December 23, 2022. We don't offer refunds for warranty work, we can and have offered to repair the spots. I didn't ignore her and I certainly think that contacting me before contacting the BBB would have been the proper thing to do.

We contracted with Malibu Pools in January for a pool that "would take a week to build" with a May drop-dead completion date. Now it is August, and it is still not completed, and I had to fire ***.Some highlights of his work: our yard has been a trashy mess for months; he didn't order all of the parts for the pool; literally nothing was done for months after digging a hole; he used the wrong size pipes for the plumbing, and it all had to be redone; he has cursed at us in texts, and then claimed they were for someone else or they were from an "old phone"; he blocks our neighbors' driveways with senseless parking; he wrecked our yard and sprinkler system, claiming restoration was our problem; and I fiinally had to call the sheriff to prevent his crew from removing materials that we paid for, after he was told not to return to the job site with an ******.We paid $33,457.Business response

I am rejecting this response because:Malibu Pools did not purchase equipment with the initial deposit. In fact, all they did was dig a hole in the ground and install the metal siding. The plumbing was sized incorrectly, and the cement tanning ledge and stairs had to be re-done.
Additionally, Malibu Pools ruined the last summer we had with our daughters at home, and the promise to finish the pool by *** was the ONLY reason we hired Malibu Pools. Unless *** has a time machine, he cannot fix this.

No, an attorney was consulted prior to the termination of the contract, but no legal action or litigation has commenced, yet.
