      We signed a contract for a new roof and some additional home repairs *** made an initial payment on 10/9 when the project kicked off. We were told there could be adjustments to the final amount due and that the final total would be confimred later torward porject completion. I was delivered a final invoice with the final amount due upon job completion on 11/14. This amount was lower than our original quote and when we questioned why, we were told it was because originally they had double charged us for solar installation work. When the job was 95% done on 12/19 they came out, reconfirmed the final amount (minus $300 for work still to be completed due to supply delays) and they took the final payment with the agreement thay we would pay $300 more when the job was finished. Then, 6 weeks later, they contacted us saying they had a billing error on our final invoice and are asking for $6k+ more from us. We do not belive this is right given we were delivered a final invoice and that they also verbally confirmed the final total at least 2 other times. We even shook on the completed deal when we wrote the last check on 12/19. They have now threatened to put a lien on our home unless we pay them extra money. This claim was all due to our home getting hit by a tornado and we were very clear up front that we were looking to minimize out of pocket costs. After they told us their price was less than what we originally agreed to, we put the funds we had initially set aside for them to other uses. It is unreasonable to demand $6k more many weeks after delivering a final invoice. Normal people dont just have that kind of money sitting around. Please help us with resolving this.

      On 8/03/2023 Mr. ***************** signed a contract with Golden Spike Roofing to replace the hail damaged roof and to remove and then reset the solar panels on the home. After insurance negotiations were completed and the final scope of work at the home was agreed upon a revised change order was signed by Mr. ******** on 10/11/2023 for the amount of $33,949.23. The change order included a full description of the scope of work. This contract amount has remained the same since October 11th and we are only seeking the funds to fulfill the contract commitment. An initial payment of $17,196.00 was paid on October 9th, a second payment of $10,322.72 was paid on December 15th of 2023 leaving a balance of $6453.51 due. On December 13th our current CFO was relieved of her duties and a new CFO was installed. I do not doubt that there were errors in invoicing that went unnoticed, however that does not change the contract, it was an error on our part not a gift to Mr. ********. Golden Spike Roofing has completed our contract obligations and we expect our client to also honor the contract he signed on October 11th 2023 and to pay us what was agreed upon by both parties in writing.

      The response from Golden Spike does nothing to address the concern. Yes, I signed a contract but then they delivered a final invoice via email for a lesser amount, which was verbally confirmed when the work was done, and which we paid. It was explained to me that the amount was lower due to double billing and then they came back to me weeks later asking for more money per the original contract.

      Shingles and decking aka sheeting installed 10/27/23. Deposit given then. Filled out 4 refer a friend vouchers each for $250. ******************** installed 10/31. ******** team was ******* to put on our ****************** due to an incoming artic ************* that night. ****** verified w/ him prior to ************* of that those decking sheets that insurance would not cover we would use the voucher money to pay for as we wanted to make sure all bad/sagging decking was replaced. To note, we had leak already in house. 11/6 contacted ****** about problems with roof. Roof sags & is NOT flat when standing on the ground looking at it. **** his ******************* with ************************* met ***** on roof. ************* both said shingles were installed properly but decking has some bad ones that should have been replaced. **** took pics inside of garage & again said he can tell from here some decking should have been replaced. ***** mentioned then that we have a leaky gutter. Emails sent to ************ "Spike" to resolve problems. Have 2 letters from Malarkey & one states "shingles look to be in excellent condition. Any issues with underlying structure should be directed to your roofer." Never heard from Spike to fix problems. Attached some emails from ****. Our last email to ***************************** sent 2/1 & er still have NOT heard back from either of them. With snow currently on our roof, we can hear dripping sounds in bedroom! Golden Spike has been stalling to fix THEIR mistakes caused by ****** and his installation team for not only the decking, but the gutters. The decking will not last with these sags as water could not only seep in but also could expand & contract the shingles, which will cause our shingles warranty to not last as long as it should. We have been more than patient in waiting as its been over 4 months since installation. Tried to attach all correspondence but file was too big. Didn't think we had to monitor this A+ BBB rating along w/ KOA *******************

      We have not heard back from you, so we wanted to reach out again, as we received the attached invoice and email from Golden Spike on Feb 27 2024. At this time, we don't intend to list our house, but there is no way we'd be able to sell our house with this saggy roof, as it wouldn't pass inspection.  You can see some of the sags while standing on the sidewalk looking at our roof!

      I agree with the dates of service provided by the complainant, I do however disagree with the accuracy of the information provided as much of the conversations between the client and my Project Manager have been overlooked. Prior to construction the client had asked our PM to replace all roof decking and bill the insurance provider for the work. Our PM ****** informed the client that our company would not ask for insurance money if the decking was not damaged by the storm as it would not be covered by the insurance company and also said our company does not assist with fraudulent insurance requests. He told them that we would inspect the decking at the time of construction, an offer to provide a full deck replacement number was not accepted as the client did not want to pay out of pocket for a complete re-deck.  At the time of construction decking was again discussed and it was agreed that we would remove and replace any compromised decking, 5 sheets of decking were replaced and the insurance provider was billed for the 5 sheets with reason and photo evidence that the 5 sheets of decking were indeed water damaged and should be included in the claim. Insurance was billed for and has paid this portion of the claim. After the job was done the client said the deck was spongy and would flex when walked on, they also said there were ****** in between the rafters. The existing roof deck is 3/8ths plywood, this is the original deck installed when the home was built. We informed the client that deflection of the plywood was typical of the materials that was in place, the shingle manufacturer sent out their representative who confirmed the roof was installed as per the guidelines of the manufacturer and it was confirmed that the roof is covered by the manufacturers standard shingle warranty. Golden Spike Roofing has provided a five year installation guarantee on workmanship that is transferrable should the home change hands. We consider our job to be done, the final inspection was approved by the city on 11-20-2023 and final payment in full is expected. The client had the opportunity to direct us to upgrade his roof deck, the client wanted the insurance provider to pay for it, we will not participate in insurance fraud, the client has offered to pay for extra decking sheets but expects GSR to cover the costs of removal and replacement of the roof materials that would need to be replaced if new decking was to be installed, the time for that decision was prior to construction not afterwards, buyer remorse is not covered by the installation guarantee.

      I am rejecting this response because: We NEVER said we wanted the whole roof replaced! We indicated that our neighbor who you did her work, that she had her entire decking replaced & insurance covered it. Weve lived here for 23 years & this was our 3rd roof that weve replaced & on each of those, prior boards had been replaced. Our last roof was done 10/2012 (prior to that 6/2004), so we knew we wanted to replace anything that was bad/saggy with the hopes of this roof lasting 10 + yrs. We asked if we could buy the boards ahead of time &****** said no. Told us itd be $100/board. We distinctively said we wanted to use the referral money ($1K) to replace those boards that insurance wouldnt cover. We verified day of install boards above front bedroom where the leak was at was replace-it was not as well as any other decking to be replace at our expense! We live in Jeffco NOT Douglas County. Nov inspection originally did NOT pass as we recd yellow notification on door. We reached out to Jeffco inspection re: visibly saggy decking & told that it is a cause for concern & should be fixed as its a sign of trouble, including roof collapsing. He had us reach out to ******* who passed our roof to ask for him to take another look. We left voice message & awaiting a call back. We know the sagging is only going to get worse over time, which is why WE WANTED TO PAY TO FIX IT! Owner Spike has NEVER placed a foot on our roof to see the poor workmanship his employees did! He also told 2 of our neighbors that he was aware of issues with our decking not being replaced that should have been. **** even indicated not only in person but in an email 1/8 favored your (meaning our) position from an engineering stance. Never received follow-up from ****** for better clarification.Anytime is good to have gutters fix, just provide 24 hr notice. We ask that final payment not take place (including no late fees) until we have Jeffco inspectors back on our roof, Spike on our roof, and our gutters fixed.

      Our stance on this complaint has not changed. On the day of construction our project manager confirmed with the client that they wanted the "bad" decking replaced. Our definition of bad decking is a non viable nailing surface, water or dry rot damage and broken decking sheets. Our crew found 5 sheets of decking that were water damaged and those sheets were replaced and billed to the insurance provider. There was a lengthy time period between the contract being signed and the actual start of construction. During that delay in material availability the client had ample time to let us know if they wanted the decking replaced. The decision of which decking was to be replaced was left to our discretion and at no time was it discussed that referral monies were to be used to purchase additional decking. The gutter problem was fixed on March 23rd and the client paid their bill the following Monday. Jefferson county has closed the roofing permit (see attachment) and no further inspections can be scheduled by GSR at the home.
