Entered into agreement for Eco to re-roof pursuant to the insurance estimate. During the process of the job they indicated there were items they would not do and we would then need to separately contract for the jobs which we did. They did not provide any adjustment for the work not performed.Business response

ECO Roof and Solar entered into a retail contract for a roof replacement in the amount of 55,000.00. There was mechanical work that needed to be completed that was outside of our scope of work. The client was to have this work complete and submit their invoice to their insurance company for reimbursement. This was NOT part of ECO's contract. The client is requesting that ECO Roof and Solar issue them a credit on their bill for this work, which we declined as is was never part of our scope of work. I have attached a copy of our contract that outlines our scope of work, which we completed.Initial Complaint

Eco Roof and Solar was hired to replace my roof and did on 6/2/21. On 6/5/21, the entire patio roof collapse including the area they had reroofed. Eco refused to come to the home site to review the damage and was presented with a forensic engineers report where it was stated the forensic engineer's professional opinion was that the composite boards on the patio roof were deteriorated and did not qualify as a nailable surface in the state of Texas. The patio collapse was a result of deteriorated wood framing members (in the layer below the composite boards which should have been replaced) and although Ryan, their Austin general manager, acknowledged they should have replaced boards as a part of the job they 1) refused to come evaluate the wreckage to see if my concerns had any merit or if the work was done correctly, 2) demanded the engineers report validating my statements that they job was not done correctly and when received they demanded payment and threatened a lien on my house, and 3) refused to discuss making right their poor and code violating workmanship. Total cost of the collapsed patio roof is approximately 40k. The roof work Eco did was approximately 4k. They offered a credit for the cost of the boards which does not begin to cover it after the work is done and the board being replaced as they should as been would have likely exposed the damaged framing.Business response

ECO Roof and Solar did install the roof at Mr. ******* property. We were notified after the build was complete that the back patio had collapsed. When we went back out to the property it became apparent that the reason for the collapse was due to the improper installation of the support beam to the side of the house as well as the deterioration of the support trusses caused by lack of maintenance from the homeowner. We did acknowledge that ECO re-roofing the patio put pressure on the structure by having weight from the crew on the structure, however our contract clearly states that we are in no way responsible for pre-existing structural issues. We did try to work with Mr. ****** to offer a small credit for the re-roof work to help with the out of pocket cost, but he was not satisfied with this offer. The report provided by the structural engineer supported the evidence that the beams were deteriorated and the installation of the patio was not done properly.Customer response

I am rejecting this response because:In their response, Eco roof and solar states that they returned to the site to inspect the collapsed structure, however at no point in time did Eco Roof and Solar return to the property to review the structure or address the complaint that the roof was installed on roof deck that was significantly deteriorated and as such that it did not qualify as a nailable surface per Texas state code as detailed in the engineering report (**** Engineering report conclusions, page 3 bullet 4). "Per the International Existing Building Code, for a nailable substrate, the integrity of a nail or fastener connection is dependent upon the product or material that a nail or fastener penetrates. The definition simply states that the nailable substrate must product an equivalent withdrawl resistance as a wood substrate in good condition" Further, "As such, it is Teal's professional opinion that wood framing members and OSB sheathing that exhibited decay/decomposition should have been replaced as a part of the replacement of the roof covering" (**** Engineering report, page 7). Eco Roof and Solar acknowledged that this should have been done in communications following the collapse, again as required by Texas state code, however the remained unwilling to visit the site and acknowledge the accountability of inadequate/incomplete worksmanship.
While it cannot be said whether replacing the OSB panels per Texas state could would have fully revealed the extent of the damage, and associated risk, of the decayed panels and framing members, it is clearly outlined by a professional forensic engineer that Eco Roof and Solar did not complete the work as per Texas state code requirements ensuring that the existing structure damage would hidden under the newly installed roofing system.
