      Woodbridge was the developer for the final phase of *** ****** ** ********* and they erected a berm along ******** ***** to divert water runnoff into a detention pond. The city of Durango notified the subdivision HOA in 2021 the berm was erected on a city easement and that it had to be removed. The developer, Woodbridge, removed the berm along with trees and graded the land, and replanted the trees. By fall of 2021 it was obvious the drainage was inadequate, backing up from the detention pond, allowing water to pool, resulting in trees drowning. The developer, **** ******, was notified in the Fall 2021 and his response was that his crews were busy and they couldn't fix until spring 2022. The property owner adjacent to the area planted more trees and they died too. The developer did nothing in 2022 in spite of contact by the HOA executive board. The city was asked to advocate for the HOA and we were told this was an issue between the HOA and developer. I became HOA president in August 2023; I have asked the developer to fix the problem and **** has offered $3,000 toward mitigation of the drainage issue. We have refused his offer because Woodbridge is responsible to make it right. We have pictures and videos substantiating the water drainage issues, unfortunately these cannot be uploaded due to the 5 Mb limit.

      I'm not in disagreement with the complainant regarding the developer's responsibility, though wish they would have expressed much earlier their complete unwillingness to initiate and manage this repair.   I had told the HOA that the developer lacks the necessary staff to either complete or manage this repair, which is why I offered $3,000 toward this task.  I viewed that amount as slightly higher than my guess of the cost.   On October 17, 2023, after realizing that the HOA had no intention of initiating this repair,  I contacted the same excavator who did the majority of the drainage and excavation work on this site in 2020.  I requested that he look at the drainage situation under discussion and give me a ball-park figure for correcting it.  He responded to me the next day with his estimate.   I mention the date of Oct 17 to make it clear that my initial contact with the excavator was before I received this complaint from the BBB.   I also emailed the HOA president  on Oct 17 to let him know the excavator would be on site looking at the situation.  

      Meanwhile, the excavator has promised to get to this job in the next few weeks as his schedule allows.   It also turns out that my guess of $3,000 appears generous, as the excavator has estimated a lower amount to complete the work, including city permits.  I won't know the final amount until I receive the invoice.  The HOA had estimated a much higher number for repairs, so that may have been part of their reason for refusing my offer of $3,000.  

      I am hopeful that the repairs will be completed within the next few weeks and that the HOA will be satisfied.

      I am rejecting this response because: The Word Is Accountability

      I am not rejecting the Woodbridge response outright, because if they, and the excavator follow through then this may be a satisfactory solution; however Woodbridge has a history of making promises, which have not been kept. I received an email from Woodbridge 10/18/23 stating they had contacted ********** ************ to fix the drainage problem, and in their words " a 1-1/2 to 2 day job" and "they expect to complete the project in the next week or two". One week has passed as of 10/25/23 and it will be two weeks as of 11/1/23 and I've not heard from ********** ************. Woodbridge first told the then president of the HOA in the fall of 2021 that he didn't have the manpower to fix the problem then, and would take care of it in the spring of 2022, which didn't happen. Woodbridge then offered money so that we could have the problem taken care of. We had a verbal quote from an unlicensed, and unbonded contractor who said he could fix it and the cost would be $4,500, which we did not accept because we want Woodbridge to be accountable - I have not been able to find a reputable, licensed contractor to fix this - no one wants to accept the liability of fixing someone elses problem. We are now approaching winter and I imagine that come spring 2024, the problem will still exist. I would love for Woodbridge to prove me wrong.
