We hired Campbell Construction to build an addition on our home in Frisco Colorado. Campbell Construction replaced a deck in error on the existing side of the home without our consent. It was not in our plans, specs or estimate. Once the error was realized, they told us they would only charge us $2k. When we received our final invoice they charged us $13k. After threatening legal action, they accepted the $2k. Now, 10 months later, the boards are coming undone, warping and we are having damages as a result of the marginal installation work and materials used. When we contacted them to correct the issue as we are inside of our warranty, they replied that because we did not pay for the deck they will not warranty the work and they also let us know that they did not seal the deck either. I find this very unethical and bad business as we did not authorize the work in the first place and now we have to pay to correct their bad work. They are non responsive. The client, ****** *****, had requested a new custom metal railing at the south upper level deck of the property and her husband **** ***** had requested that several warped boards at the south upper level deck be replaced. During field investigations and while the warped deck boards were being removed it was discovered that the deck structure was rotting and was unsafe. At this time Campbell Construction informed the clients the structural joists would need to be replaced or sistered with new structural joists, and all of the existing deck boards need to be pulled up and reused/replaced to make this happen. The clients gave Campbell Construction approval to perform the minimal amount of work needed to repair the deck and replace/reuse the deck boards to ensure the deck structure is safe.
Throughout the course of the deck work Campbell Construction included the cost changes in every invoice sent to the client for review and approval, and every month the client approved the invoice and paid in full until the final invoice was issued. After the final invoice was submitted to the clients for review and approval they decided they didn’t agree with their previous invoice approvals and/or payment amounts because they didn’t review the invoices and made payments blindly. Now they wanted to short pay the final invoice by thousands of dollars for numerous scope of work changes they had asked for, but then decided they didn’t want to pay for it (including the deck issue). After numerous meetings between the clients and Campbell Construction we finally settled on a final invoice amount. Campbell Construction was forced into the settlement because every time Campbell Construction disagreed with the clients they threatened to sue which in the end would cost more than the settlement amount even if Campbell Construction won.
The added south upper level deck scopes of work were included in the amount of money that was not paid to Campbell Construction and therefore it is not included in our warranty to the clients. Furthermore, Campbell Construction has been extremely responsive to the client requests throughout the punch process and warranty process. This is the only claim we have informed the client of not being covered under warranty because the work was never paid for.Respectfully,

I have read the response from Campbell Construction. The information in their response is not accurate. We hired Campbell construction to perform a large job. Part of the job was to replace a deck railing. Campbell construction never informed us that the deck structure was rotting or unsafe when they went to install the railing. In fact, they had asked us if we wanted to replace all the deck boards prior to doing the railing and gave us a price and we sent an email, which I have , that stated that we did not want the deck replaced. Ahead of that decision, I had a structural engineer inspect the deck and it was deemed safe resulting in our decision to not replace the boards. I can provide an engineer’s cert for this as well. Scott Campbell later told me in a phone call that they decided to go ahead and replace the deck because it was rotting. I was really frustrated because if we had received communication of the rotting wood, we would have made a decision to select a different material for the new deck. Both my husband and I were very frustrated and reminded him that we did not want the deck replaced per our email and that the work was not part of the plans or specs. Scott apologized for the miscommunication and told us he would do it for $2k total. We did not receive another invoice until we received the final where he charged $9k for the deck. Scott lied multiple times and tried to say that we authorized the work. This is untrue and he knows that. When I reminded him that he said the cost would be $2k, he explained that he only quoted that because he thought he could make up for it in other areas and he was not able to. Finally, when I threatened to take legal action, we had a conversation with Scott and Pete where they agreed to charge the $2k that was agreed and we paid the final bill. In summary, Campbell construction did work that was not authorized, they lied, they did not respond to multiple communications, the poor craftsmanship of the deck resulted in expense to us and they refuse to provide a warranty on the work. I have all communication documented by emails including where they admitted fault and agreed to the $2k bill, which was paid in full. I have found Scott Campbell to be very dishonest, lie, and be very non responsive. I have many examples of inquiries that were not responded to. Lastly, we also have a large crack in an interior wall they installed and they refuse to fix this as well and told us to go back to our architect. They are not ethical and I would not recommend doing business with them. I request the wall and deck be fixed and that we receive financial compensation for our time. Thank you.Business response

We are responding for the last time to the complaint of ****** *****.
Campbell Construction, LLC has been in business for 23 years in Summit County, we have an outstanding reputation as a builder and support of our clients in this community. We also plan on being around for many more years.
Campbell Construction builds a quality product and we take pride in what we do. ****** ***** was very difficult to work with, had unrealistic demands, made changes all the time, which we included in all of our monthly invoices, which she claims not to have looked at and paid blindly.
We have never seen anything in writing about the condition of the deck, but it was not maintained before or obviously since. There is no question that the old deck joists and beam were rotted from the top side which was not visible until some old deck boards were removed. We do not feel it is Campbell Construction responsibility to repair their deck again as we were never paid for it.
Once again, we would like to say that we tried to take care of the *****'s but their attitude and demanding nature made it very difficult. Also, all other customers that have worked with Scott appreciate his hard work and honesty.
We feel that we have done everything that needs to be done and would like this matter closed.

I am rejecting this response because what they are saying is untrue. We paid the final bill in full (am happy to provide) and the work they did is poor workmanship and needing repair. We brought this to the attention of Campbell Construction within the warranty period.
