      I got a fraudulent charge by my apartment complex after I moved out. They said that I had damage to my carpet and showed that a portion of the room that needed to be replaced. They are trying to charge me $1,200 total for the issue. I reached out for estimates and the most it would cost by all 3 people was $200. Aside from this, the air conditioners were leaking in the apartment water everywhere which johnstown plaza has a responsibility to maintain. They also did nothing for the water damage after that at that time, and now way down the line they are trying to say I did the damage almost 2 years later. So ultimately they are overcharging me by 6x the correct amount, and they are charging me for something that is 100% their fault, so this is fraud. I am going to be filing a complain with small claims court but I was hoping I could get more information from here first. Thank you for your help in pursuing action against the apartments and their management company. The total amount they are trying to charge me after they took my deposit is $463.03 which I am also sending them a certified letter for them to return my full money.

      We had to change the carpet due to pet urine and the smell of pet urine. I have attached a couple of pictures of the pet urine and can also provide more pictures. The total of the carpet replacement was $1,049.28 and we only charged back $612.15. I have attached the resident ledger, so you can review and see we didn't charge $1,200.00. We use the same company to change out all of our carpet here at Johnstown Plaza. The company we use is Real Floors. The only other thing Mark was charged for was his final utilities.

      I am rejecting this response because:

      First off, they have sent so many "resident ledgers" that have had so many different amounts they are trying to charge us its almost impossible to not see how fraudulent they are being. I will attach 2 of out the many they sent me to show how they are trying to steal every penny they can. They did not even say anything about changing the carpet at first. The only thing they said was done was carpet treatment. I went ahead and called real floors after this and confirmed with them that Johnstown Plaza is lying and I have a recorded phone call with this. They stated to me that they do no type of treatment work at all and they only replace the carpet. After this, Johnstown Plaza tried coming back again and rewording another "resident ledger" because they realized they got caught in their lie. I will attach this. So going back and forth, they for sure tried to charge me over $1,200 incorrectly total at first. So right now the total fraudulent charge is down to $1,049.28 for the real floor invoice. If you look at the real floor invoice, you can notice this isn't even anything that remotely looks like it can be correct. They are charging a quantity price of 57.67 on every single item and clearing making a fraudulent invoice. I would like to know if Johnstown Plaza and Real Floors are connected in any way and this can be investigated further by the BBB please. In my 15 years of being an accountant, I have never seen this fraudulent and unacceptable of a way to bill someone. The way they clearly made up things on the invoice is disgusting along with the extreme differences in market price for labor and materials than what they show on the invoice. Line item 1 on invoice: You cannot bill $57.67 per SQ for Fox fur. Line item 2: $57.67 for FHA per SQ. If you compare line item 1 and 2 the square yards should be easy to figure out on the invoice, yet the amounts billed do not match in any way. Line item 3: 57.67 each for install of labor. Line item 4: 57.67 for pet enzyme labor. If you notice by the trend, it simply is fraud to be doing this, and you can tell easily with line items 1 and 2 with the square yard charges. Another really concerning thing is obviously that every line item is 57.67. I have never seen an invoice that looks this fake honestly. 

      Johnstown Plaza stated above that they use Real Floors Inc for all their needs. If this is the case, this obviously needs to be investigated way further based on the invoice they provided from real floors and the obvious discrepancies and concerns in the invoice. This is an obvious move out scam where they are trying to charge people incorrectly and excessively high amounts which can easily be seen with a little investigation on just the numbers they provide in the invoice. I would also like Johnstown Plaza to respond if they have any relationship in any way with anyone at Real Floors Inc. 

      Aside for the fake invoice, they also violated my personal rights. They included my my old roommate on all the communication at first when they had no right to do so. This person was taken off communication fully over a year ago and Johnstown Plaza felt it was appropriate to share personal information without doing any due diligence. When I told them it was violating my rights, they went ahead and sent one more email with her included. Along with this, a whole new lease was signed when my old roommate moved out. At that time, it is Johnstown Plaza Apartments responsibility to check the apartment and make sure it is a livable space for the tenants. They did nothing to check for any damages at that time, and I will not be responsible for another one of their mistakes. Real Floors should have come out when the new lease was signed, so I will not be responsible in any way for Johnstown Plaza dropping the ball legally while also trying to impose fraudulent charges after the fact. They are wrong in a multitude of ways and I really hope this is also investigated further. 

      Another issue that they failed to address was the air conditioners that were leaking water all over the apartment that Johnstown Plaza has the responsibility to maintain. When I noticed it I called them out immediately, they fixed the air conditioners, but they did absolutely nothing for the water on the carpet that was left. So yet again, I will not be paying for another one of their mistakes. I will attach all email communication where they fail to address any valid concerns but instead they keep generating more fake invoices, which will be attached. I appreciate the BBB taking the time to review both companies here. Please let me know if I need to leave one for Real Floors Inc. as well. 

      As you can see from all proof above, Johnstown Plaza Apartments is wrong in a multitude of ways yet they keep trying to pursue their scam while also violating my rights. Not only are they violating my rights with my old roommate, but they clearly also violated my rights I have in my lease where they need to maintain my apartment which I pay them each month to do, and they failed to do so by not removing any water when the air conditioners leaked. They also did nothing to make sure my apartment was okay to live in when I signed a full new lease. This is very concerning that they are still trying to charge me for damages when so many things described above are Johnstown Plaza at fault.

      I noticed that they said they can provide more pictures. When they first sent everything I made sure I told them I wanted all documentation and all pictures showing what damage they were trying to make up.

      Everything they sent originally on the BBB post is everything they sent to me, and anything else they are trying to make up here I just want to make sure it is timestamped. I would also like proof that it is my apartment as well which they should have timestamped photos on that date. The pictures really don't even look like my apartment at all.

      I have tried to give my landlord my notice to vacate. My lease is up on August 2nd. They say I have to give 60 days, but they didn't even give me my offer to renew until June 7th which was a Friday and they aren't there on the weekend. I have tried all week to give my notice and they said the first paper that i gave them saying i intended to vacate wasn't sufficient and it had to be a paper from them even though that wasn't specified. I have come into the office multiple times to address this and they have left early and today I went at 430 when they close at 6 and the office was locked and no notice was given saying they wouldn't be there. They're trying to force me to stay past my lease end by saying my 60 days doesn't start until they have this paper yet they have remained unavailable and have avoided me. I have made multiple attempts to give them my notice and they are leaving early or closing early. This is not my fault and they are trying to force me to stay longer by not taking my notice to vacate. This company needs to be investigated.

      We received written notice to vacate from Garret Mullins that lives with Lisa on 6/12/2024. There notice to vacate has been entered into our system with a move out date of 8/2/2024. When Lisa came by the office on 6/14/2024 my assistant manager was out on tour and I was in building 2 with our elevator company. Our office hours are Monday through Friday 10am to 6pm and Saturday from 10am to 5pm. We have someone in the office at all times unless showing an apartment, onsite with a resident, or onsite with a vendor. I have attached the written notice to vacate form that was brought into our office on 6/12/2024 and our notice to vacate form that was brought into the office on 6/17/2024. I have also attached the lease agreement showing the require a 60 day notice. If you have any other questions or concerns about Lisa's account please let me know.
