      In July 2023 we contacted ******** about building a pavilion for **. *********************, contractor told me that the cost of $2,750.00 on a previous estimate that expired June 23, 2023, was the price listed on a ****** pavilion picture from pinterest that I had emailed to them. We had some work done off this estimate prior to expiration of the estimate, but had not signed off on the estimate as it listed costs for a pergola, and a pergola wall, which we did not want built. (I had sebt a pic of a pavilion). Since ****** no longer sells these kits, the contractor recommended Pergola Kits ***. We decided to purchase their 10x14 foot pavilion kit, and had the contractor review the building specs that we were required to sign off on before the company would build the custom kit. The contractor also digitally signed this document for us. When the crew arrived to build the pavilion on 10/2/23, ********************* asked if I would agree to the labor cost of $2,750.00. I agreed. The contractor was not able to finish the project (letter to contractor outlines specifics).I have contacted **************** to fix and finish the structure and roof the pavilion. I am refusing to pay until work is complete. (Letter, documents, and photos will be sent by mail).

      We agreed to the $2750.00 to install the pergola. We built the pergola and had started the roof of the pergola when ***** asked us to stop and asked us to do the roof again. We removed all the shingles and started over on the roofing. Again after getting halfway done ***** again asked us to stop. She had obviously lost trust in us putting the roofing on. ***** then called me on the phone agreed to pay the original amount immediately. I had an employee go to pick up a check and she refused to give him the check. ***** asked that I give her a written receipt saying they are paid in full then she will give me the check for $2750.00. That is the last time I was able to get ahold of ***********

      I will be forwarding a package of documentation via postal service.  I am waiting for an inspection report from chief building inspector, **************** with code violations.  I will overnight copies of theese documents when I receive them.  Thank you,  ***********************

      I have documentation that contradicts the Schwabees statement above.  I will be forwarding a packet of information via US ************** soon.  I am awaiting email letters from the **************** ***************** Chief Building Official, *******************************, which I should receive next week.  I will overnight all documentation when these letters arrive.

      I have tried contacting ***** multiple times to discuss a solution on the pergola. ***** did not get a permit for the project so I'm not sure why she is getting information regarding code violations. In the ***************** the home owner is responsible for acquiring a permit for any work done at their house and are responsible for any violations to local building codes.

      However ***** is also withholding money from us on other work completed. We built a retaining wall and fence and installed landscape edging and rock. She was very happy with the work and paid $5000.00 of the balance of $5975.00.

      This work was separate from the pergola installation and still hasn't been paid. We are ok discounting the pergola based on the roofing cost if ***** is willing to pay this balance immediately.

      I am currently waiting for 2 letters from the **************** ** Chief Building Inspector, ***************************, that lists the building violations and what needs to be done to bring the building up to code,   Another letter will state that the business was not licensed, did not pull a permit as required by code, and was an illegal build that constitutes fraud.  I hope to receive this by email sometime next week and I will forward a hardcopy in a mailed packet of information.

      I am still receiving reminder notices from the business for payment.

      I priority mailed an information packet to your office last week which you should receive on Monday 11/27/2023 per the post office.  I will email the letters from the city Chief Building Officer when I receive them.  According to the building inspector, the business is not licensed, did not pull a permit to build, does not meet code, and is therefore an illegal build that constitutes fraud.

      Hello,

      The Chief Building Inspector, *******************************, came to the house again yesterday (12/8/23) to take more photos.  He is said he is writing a letter to be sent to the contractor outlining code violations.  He will forward a copy to me when he mails the letter to the contractor.  I will forward a copy of that letter to you as soon as I receive the letter.

      Hello,

      The Chief Building Officer from the ******** ********************** came to the house 12/8/23 to take more photos of the project.  He is writing a letter to the contractor listing code violations and will forward a copy of the letter to me when he mails this to the contractor.  I will forward the letter to you when I receive the letter.
