    I am filing this complaint regarding the purchase of a 2014 ********** Tiguan R-Line from Victory Motors Colorado on November 9, 2024. While the vehicle was sold "as is," which I understand the implications, I also declined the dealerships optional warrantywhich would not have covered the current defectsthere are significant undisclosed hazards (mold) and defects that surfaced, less than 48 hours after purchase. It is now unsafe, unusable, and severely devalued. I noticed a foul odor and extreme condensation on the windows, which triggered my sons asthma. Concerned, I had the vehicle inspected by ********** of Greeley, where mechanics discovered the following issues: severe interior damage caused by mold, a broken sunroof motor, clogged and broken sunroof drains, a dirty and damaged sunroof track, a cracked sunroof, and persistent water leaks causing extensive water damage. ********** of Greeley attempted to mitigate the water damage by vacuuming the interior, detailing the vehicle, and storing it in a temperature-controlled garage, but they were unable to fully dry the car or resolve the mold issue. These defectsespecially the moldpose serious health and safety risks and were not visible or disclosed at the time of purchase. Victory Motors initially minimized my concerns, claiming the issue was limited to the sunroof motor. After the initial discussion, they failed to follow up, leaving me to contact them a week later. At that time, they offered a trade-in value of $9,700 toward another vehicle on their lot, which is below the purchase price. I declined the offer and requested a full refund due to the hazardous and undisclosed defects, but this request was denied outright. The dealerships failure to disclose these critical defects and their unwillingness to resolve the matter fairly has left my family with a vehicle unfit for use. I am seeking a resolution in the form of a full refund for this defective and hazardous vehicle.

    We understand your frustration regarding the condition of the 2014 ********** Tiguan R-Line purchased on November 9, 2024. As the vehicle was sold "as is" and you declined the optional warranty, it was understood that the vehicle's condition was accepted with no coverage for potential future issues. That said, we make every effort to inspect our vehicles thoroughly and ensure that all known issues are disclosed to our customers.
    After your concerns about the vehicle, particularly the sunroof and the odor, were raised, we took immediate action to investigate the matter further. Victory Motors conducted a comprehensive inspection of the vehicle and, based on our findings, we found no visible signs of mold or any permanent damage caused by the sunroof issue. While there was a concern with the sunroof motor, we could not find any evidence that the water leakage or sunroof issue had caused significant or lasting damage to the interior.


    Despite this, we understand that your experience with the vehicle was not ideal, and we wanted to offer a fair resolution. As a gesture of goodwill, we offered to repair the sunroof issue at no cost to you and/or assist with trading the vehicle for another option from our inventory. These solutions were offered even though the vehicle was sold "as is," and we are committed to making sure our customers are satisfied with their purchases.
    We respect your decision to decline the trade-in offer, but please know that we made this proposal in good faith to address the concerns and provide a reasonable solution.
    While the vehicle was sold "as is," we regret any inconvenience youve faced and are genuinely committed to working with you to find a resolution.     I am rejecting this response because: we would like to trade the vehicle for something on the lot on the terms that the vehicle is the same price ($9,999 or $10,626.15 when we were walking out the door) not the $9700 that was offered on the phone or in the letter.  We would also like the ability to get this trade reviewed by a mechanic of our choosing to get a PPI so we can make sure that this does not happen again prior to final sale.

    Although we did buy "as is" I do want to point out that in the state of Colorado there is a Consumer Protection law that protects a buyer when purchasing a used car "as is" that way these types of things can be taken care of.  There is damage to the inside of the Tiguan that is not visible unless you test specifically for mold or pull out the carpet to test. 

    I look forward to hearing from Victory Motors and hope we can come to a solution that both parties are comfortable with.

We have no other offer at this time.
    As much as we strive to ensure complete customer satisfaction, the Consumer Protection laws in Colorado do not require us to modify the terms of an as-is sale or offer a different price based on conditions that were not present during the transaction.     Victory Motors of Colorado On 9/16/24 I bought a 2011 Dodge Ram 1500 from Victory Motors. Absolutely worst decision I have ever made.I had it inspected, and they determined that there were a few repairs that needed to be done. Victorys response was, Thats all-normal repairs on a truck of this age. It had ******* miles The truck was in great condition inside and out, so I bought it.Well 2 weeks later I took it on the highway for the first time..and when I hit 70 mph the engine quit delivering power and I coasted down to 60 mph.then it stopped again.then when I hit 70 mph it did it again.I have now had it serviced by 2 mechanics and no one can figure out what is happening. So far Ive spent over $2,200 , and its not done yet I will never buy anything from Victory Motors again!!**** ****

    Mr. **** purchased the vehicle on September 16, 2024, with the understanding that it was sold as-is. At the time of sale, he declined any and all warranty options, which is clearly outlined in our sales process.
    We understand that Mr. **** is experiencing issues with the vehicle after only a short period of ownership. While we empathize with his situation, it is important to note that purchasing a vehicle as-is means that the buyer accepts the condition of the vehicle at the time of sale and assumes responsibility for any future repairs.

    We recently purchased a 2014 Subaru Forester from this business. After bringing the car to an established auto repair business for an inspection, it was determined that there are significant problems with the car and instances of what we feel are outright dishonesty from the salesperson (******), who:a) did not disclose that there was only one key for the car until we had already signed paperwork.b) stated "I will fill the wiper fluid for you and the fill wiper fluid alert will go away (it is actually a faulty sensor).Additionally, we have documentation that the vehicle has a leaking valve cover gasket, a leaking timing cover gasket, a leaking crankshaft seal as well as numerous other issues.It is obvious that either this business does not inspect vehicles prior to selling them, or does inspect but does not disclose problems to a potential buyer. These are both bad business practices, particularly for a car dealer that purports to be an established community business.We would like to return the car for a full refund, or a partial refund that covers the cost of numerous issues that we have documentation for.

    On August 23rd 2024 **************** purchased a 2014 Subaru Forester from Victory Motors of Colorado, This vehicles like all used cars in Colorado was Sold AS-IS, **************** signed several documents stating that it was an as is sale with nothing promised or implied. Victory Motors of Colorado offered a comprehensive warranty at the time of sale that would cover the components needing to be replaced. *************** declined any and all coverage taking responsibility for any repair's needed in the future. Even though nothing was promised during the sale of the ******* Victory Motors reached out to **************** after reading this message and offered to help, We got the car into a trusted repair facility here in town and offer a substantial saving on any repairs he wished to complete.

    I am rejecting this response because: Victory Motors of Colorado's attempt at resolving this matter was to have us pay over ******* to address problems that were present with the car they sold us. I was told by the manager that this could only be addressed by a shop across the street from their dealership that they obviously have a relationship with. Part of this offer involved signing a statement to essentially make the BBB complaint go away. Online reviews suggest a pattern of selling cars with problems and offering this type of resolution when faced with complaints. The inspection and estimate I submitted to them for reference was from a BBB accredited shop with an A+ rating, whereas their shop has no reviews or rating with BBB. This ridiculous offer showed no goodwill whatsoever and sheds light on their business practices.

    At test drive, engine light was on, seller assured us that engine engine issues would be taken care of. At delivery, driver stated that battery was bad and had to be jumped to get it into the drive. Battery was replaced by us Drives 3 and 4 engine was on, and vehicle overheated. Coolant was replenished. Drive 6 the vehicle would not restart while out and was towed to ************. Initial inspection revealed that the vehicle had been power-washed but there was black gunk on the starter, orange stained spark plugs and coolant lines. Coolant lines were cracked and broken at the top. Thermostat, water pump and starter were defective. Repairs totaled $1930.88. Drive 8 vehicle overheated and engine light was on. Evaluation from mechanic after 3/4 3engine failed tests suggested head gasket issue. I shared the repairs done, and invoices for engine repair and replacement and that title for vehicle had not been received. We were offered compensation for the battery. He suggested a second opinion, which we did. On the way to 2nd to second mechanic, engine light was still going off. Mechanic noticed spark plugs were not aligned, causing contact and compression and vehicle failed 4/4 engine tests. He agreed with head gasket issue. shared issues with Victory Motors GM and after several weeks of conversation/text with there was no resolution.. We repaired the head gasket, a total of $3207.00. We paid for a $318. to receive a title. Plates and tags were received 2/27/24 and title received 3/7/24. We weren't expecting a perfect transaction, but we were expecting a title and engine issues to be resolved as promised.

    BBB: On July 20th 2023 *********** Purchased a 2001 Jeep Cherokee from Victory Motors of Colorado.

    -Prior to the purchase *********** hired a third party mechanic to complete a "pre- purchase inspection"

    -Following the inspection our customer notated due to the age of the jeep being 20+ years old the report had recommended spark plugs be replaced. NO Other mechanical issues were  disclosed by the customer or the mechanic who completed the inspection.

    -During the sale a mechanical warranty was offered which was declined by the customer assuming all responsibility for repairs moving forward. Three separate documents alerting the customer to the "AS-IS" sale in ******************** and explaining the benefits of the warranty which would of covered all issues *********** listed on her repair report.

    -After almost two years since selling the 2001 Jeep Cherokee "AS-IS" to ***********, Victory Motors would have to decline the request to refund the customer. ********************** made serval attempts to offer help in good faith that were repeatedly turned down by the customer stating they were not sufficient.

    I am rejecting this response because:  This was an out of state transaction.  A family member from ******************* test drove the vehicle and noticed the engine light on.  
    No third party in the state of Colorado was contacted or hired by me to do a pre ***e inspection as stated by Victory Motor

    At no time did I ever have any conversation  where I "notated" anything pertaining the age of the vehicle, recommended spark plugs or stated "No other mechanical were disclosed," as Victory Motors claims.  Knowledge of sparks being replacement came via a text from our sales associates on 8/1/2023, just prior to delivery.  

    This was an "As is" agreement based solely on the mutually agreed stipulation that the engine issue  be resolved prior to sale.  

    The sale originate on 7/20/23, 8 months ago, vehicle received on 8/18/2023, 7 months ago, not 2 years ago as claimed by Victory Motors.

    I was required to pay for a bond in order to obtain a title.  This was the sellers obligation.

    Over $5,000 after purchase has been spent to have a working vehicle, not including required auto insurance.

    2/26/2024 * I purchased a vehicle after making an appointment to test drive a couple of cars at 2pm. I eventually purchased a car and finally left the dealership after 7pm. Buying a car should not be this agonizing. *Sales person, *****, told me that my credit score was 680 or 690 or 689 or something like that and that is why my interest rate was higher. I had the ability to check all three bureaus on my phone and my lowest credit score was a 749. I quickly found out that all the employees lie to get you to buy a car. *The vehicle had a low tire pressure indicator showing; when I brought up the concern, the response I get was: Oh, thats because of the fluctuations in air temperature. What? It was 61 degrees when I looked at the car. Then they offered to have the tires topped off. This never happened. I took the car the next day (had to take time off work) to a tire store for them to fill my tires to the recommended pressure then the light went off. The employees didnt go out of their way to address my concern. *When I purchased the car and left after waiting for 5.5 hours, I was told that I would get a copy of the carfaxthat never happened until I asked for it three times. Plus, my loan app was missing. *The next day on 2/27/24 while driving to the store, the check engine light came on. I also noticed that the clock was about an hour and a half wrong on the dash. This tells me that Victory Motors is very deceitful by disconnecting the battery to make the check engine light go away to sell the car. Instead they should perform a full inspection and fix whatever needs to be fixed before putting the car on the market. * I now have to take additional time off work to investigate the check engine light and actually get the car repaired!

My car is in the shop, and she said 2nd inside pads and rotors need changed just a little pad on but not covered it's maintenance.it overheated and there is a crack, they want 500. and some cents I want my money back and maintenance money, who does this?     This is more than repair issues, they charge ********* interest on this vehicle, since I asked for ******* off they did, they only offered ******* for a trade. They are taking over half for interest in their cars. Not a repair issue only,

    On January 14th 2023 ****************** purchased a 2015 Buick Encore. After reading the initial BBB complaint. Victory Motors is having trouble understanding where the issue lies. The Vehicle was sold for full price and paid for by cash, no interest was charged like complaint stated. Furthermore when ****************** brought the vehicle back, there was no appraised value stated to purchase the vehicle.

    After failed attempts to reach our customer by phone to discuss any issues ***************************************** would be able to help with. We will hopefully be able to resolve any issues or confusion on the original deal with this message.

    On 4/5 at approximately 5 pm we signed an "as is" contract with Victory to purchase a 2017 Highlander at a fair market price (~$27,250). We took delivery and drove the vehicle 1 mile home. At 6:30am on 4/6 we drove the vehicle to ******************* in ******* for service (~14 miles). ****** discovered that the axle was improperly installed and the front brakes, right axle and right bearing needed immediate replacement. It was clear to the mechanic that this damage had existed for many miles. *** vehicle was deemed unsafe to drive. We contacted Victory and they refused to make the repairs and asked to see the vehicle to confirm the damage. At our expense (~$195) we had the vehicle towed to Victory. ***ir mechanic verified the problems and recommended the same fixes. On 4/7, Victory offered to pay 18% of the repair bill if we used their shop and the cheapest non-OEM parts available. We turned down that offer and asked that Victory refund the transaction or complete all the repairs with OEM parts. On 4/8 Victory offered to pay about 2/3 of the bill that would complete the work with ****** parts if we signed an agreement not to pursue further action. We again asked that they either accept a return of the car or pay the full cost of the repairs; Victory refused. We had the car towed again at our expense back to ****** to complete the repairs at our expense (~****). Throughout the process, Victory has maintained they have no responsibility for an "as is" vehicle. We contend that emissions and safety items are excluded from "as is", and so they are in fact responsible. Because this was clearly a pre-existing safety issue, we believe they are responsible to take the vehicle back, or make all repairs.

    On 4/3 customer initially came to **********************, by himself, to test drive the '17 ****** Highlander that was subsequently purchased.

    On 4/4 customer asked for help facilitating a pre-purchase mechanical inspection at his choice of mechanical repair facility. Customer asked that ***************************************** bring the vehicle to Carworks. Customer informed ***************************************** that he had owned a ****** Highlander in the past and that Carworks had completed services to his satisfaction.

    On the morning of 4/5 customer came to ***************************************** to purchase the vehicle as he was satisfied with the pre-purchase inspection. He did however negotiate $750 off of the price based on the maintenance/recommended repairs needed. Customer did not take delivery of the vehicle until approximately 5pm. He had completed the signing of all paperwork, including the buyers guide marked AS Is - No Dealer Warranty earlier that morning. At the time of sale, customer was offered the option to buy a mechanical warranty but chose not to. At the time of sale, customer was made aware the vehicle did not have any implied or explicit warranties attached.

    On 4/6 customer reached out to ***************************************** and spoke with the Sales Manager expressing that he had taken the vehicle to another mechanical inspection, at a different mechanical facility, post sale. Customer relayed the findings of that post-purchase inspection, completed by ******************* to Victory Motors. He then asked that Victory Motors pay ******************* directly for any and all needed repairs. As a courtesy and under no obligation, Victory Motors offered to have a shop familiar to the dealership assess the needed repairs in an attempt to save the customer money on both parts and labor.

    On 4/7 Customer chose to exercise this option and towed the vehicle to the other repair facility. That repair facility agreed with ****** ******'s assessment of needed repairs. The needed repair was quoted at $1,050 which was substantially less than ******************* had quoted. At that time, the Sales Manager offered to contribute to the repair cost. It was proposed that first, the customer would  pay the amount that ***************************************** had discounted the vehicle at time of sale. Then Victory Motors would cover the difference. Customer did not accept that help. Instead, he requested that Victory Motors pay the repair bill in total.

    Later on 4/7 after multiple conversations between the Sales Manager and the customer it was agreed that ***************************************** would pay the entire $1,050 repair bill. Customer expressed his extreme satisfaction with that agreement.

    On the morning of 4/8 the customer reached out the ***************************************** again. He stated that after discussing with his family, he was unhappy with the deal that he had agreed to with Victory Motors the previous day. At this point he demanded that all parts used in the repairs be both OEM and ordered directly from ******. The parts that were to be used at the time of the agreement were brand new parts that carried the same warranty as an OEM part from ******. That was still unsatisfactory to the customer. At this point it was clear ***************************************** would be unable to satisfy the customer and it was agreed we would go our separate ways.

    I am rejecting this response because:

    The key assertion I make is that the vehicle was not mechanically safe to drive when I took possession on 4/5. Both the mechanic that did the pre-inspection (Carworks) and the mechanic at ****************************) concur that there is plenty of evidence that the issue was preexisting and not a result of something that happened in the **************************** particular the level of wear on the exposed internal parts, including rust, and evidence the parts had been previous adjusted inappropriately. For instance, you can see marks on the parts surrounding the axle nut and near the exposed splines of the axle.

    Based on the rules put forth by the Colorado **** of ******* (******************************************************************************), there are two exceptions for an "as-is" vehicle. Those two exceptions are emissions and safety items. Given that this car was not safe to drive, and was not safe at the time I took possession, I assert that Victory should have offered to fix the vehicle or return it immediately. When notified, Victory was and continues to be adamant that they have no liability and are not responsible.

    As a consumer, I am a novice when it comes to the used car buying process, but Victory is literally in the business. When they tell a customer that are not responsible, a customer would assume they are being truthful and would know the rules. When I read the rules myself, it seems pretty clear they are not being truthful. It is for this reason that I feel I need to bring this issue to the attention to the BBB.

    Victory: Is your position that the issue with the car took place after I took possession OR that this is not actually a safety issue like that protected by state law?

    Note: I do NOT make the claim that Victory knew of this issue at the time of sale. The mechanic at ******* was not able to diagnosis the issue right away and was only able to do so once the wheels were off the car for a rotation. He also had the unique knowledge that this issue that can trigger a wheel speed sensor error that was evident before the time of sale and his reason for investigation further.

    I purchased a 2018 ********** F150 from Victory Motors of ******** Colorado the afternoon of October 12 2021. I test drove the vehicle, purchased it (financed) and drove it home. Immediately after arriving at home I notice the vehicle had a loud tick. I returned to the dealership within only a few hours of purchasing the vehicle and they confirmed that there was engine damage and it needed to be repaired.I needed to leave the vehicle for them to look at. They were unclear but hinted that more severe engine damage could occur if I continued to drive the vehicle. They also told me that repair could be at my expense but they did not know until investigating the damage. I asked the salesman to return the vehicle and he said they could not. I asked they cancel the loan and he said the loan was already funded and they could not even though only two hours had gone by. I persisted and he brought over the sales manager and both said the truck was sold as is and they would try to repair it but would not tell me how much it would cost or if it would be at my expense or not.I put less than 30 miles on the truck and returned within just a few hours after purchasing it. I understand the as-is law but this seems like a purposeful abuse of the law and if the engine were to fail while driving a possible risk to my and my families safety (though that is a remote possibility to be honest). The dealer was fair in the sale of the truck so to see them turn so quickly and negatively makes me think that this is standard and unethical practice and something should be done. I tried to speak technically with the mechanic diagnosing the truck, and general manager, asking them to put their ear to the underside of the truck where the noise was loudest and they rudely disregarded anything I had asked.The auto industry is a mess right now. I cannot believe we are still in these used car salesman stereotype. Something needs to be done.I am simply asking for return of the vehicle.

    This dealership sold me a car with problems. Two weeks after I bought the car the battery died, it was 5 years old. A good dealership would have prepared a car for sale. When I bought this car the key FOB did not work, the manager tried to fix it but couldnt. They said they would be contacting me within a couple days and they would send someone to get me a new key FOB. Five calls later and nothing came out of it, I still do not have a fixed key FOB. The car is a mess and I have dumped over $2000 into fixing it. While looking at my options with this car, I was told by a bigger dealership that the timeframe they gave me to get an emissions test done was a scam. Victory motors had me sign a paper that said You need to get an emissions test within 3 days of the purchase. I did get an emissions test, and a week later is when this car was having issues. They make you sign this paper so you are forced to deal with lemons and cars that are not ready to be sold. After dumping $2000 into this car it is still having issues, and the warranty they gave me doesnt fix it!!! All in all, this dealership is a scam who sells broken down cars that are not worth the price. What would help is if they buy this car back from me and pay the loan off in full so I can get a car that actually works and wont leave me broke.

    ****************** purchased a car from Victory Motors of Colorado roughly 3 months ago.

    At the time of sale after agreeing to the numbers she had motioned the key fob wasn't operating in an acceptable manner. Victory Motors of Colorado agreed to help and contacted a mobile key company that offered to go to her location to complete the repair. After multiple unsuccessful attempts to get ahold of ****************** the company quit pursuing the matter.

    As far as the emissions complaint Victory Motors of Colorado provided a state issued vehicle emission voucher which the state dealer board recommends and enforces, it is state law that the vehicle is guaranteed emissions for 72 business hours. 

    If ****************** had reached out to notify Victory Motors of Colorado about an issue with the battery we would happily had a replacement installed for her.

     

    At this time would not be able to reach the desired settlement.

    The purchase date was April 26, 2022. I trade-in a 2016 **** fiesta with 16k miles and. I was told that my vehicle was only worth 8k dollars and that the only vehicle in my budget would fit was a **** **** escape with 92k miles and an addition $500 dollars cash was taken from me. The airbag light is on, the check-engine light is on, and the battery light is on. I have taken the vehicle to victory motors of colorado with no resolve. The first time they said the check engine on was due to an oxygen sensor, they held the car for a week wasted my gas, (never filled it back up) gave me a reciept for work done, check engine still remains on. They took it in again for another occasion to their own mechanic and said they spent $400.00 dollars to fix the issue, sent me a receipt for $111.00 dollars and the check engine, airbag, and the battery light is still on. They made me sign the title slip to take delivery and now they are not fixing the issue. The car DOES NOT run. Upon further investigation the underside of the vehicle is completley rusted out and the chassis seems to be breaking. I am a veteran, i have a ******, im disabled, im 65. I have doctor ************* This is not right nor is it fair. This car is not road legal.

During the buying process ****************** was offered and encouraged to purchase an extended warranty for the vehicle given its age and miles. ****************** declined any and all coverage assuming complete accountability for the vehicle moving forward.     I am rejecting this response because:When I traded in my 2016 **** Fiesta that had ****** miles on it,  I was looking to go into a 4-whee drive for the harsh Colorado *******. It does not seem very accurate to me nor did it at the time that I was trading in a 2016 **** fiesta that is valued at $15,000-$17,000, for a **** **** Escape with ****** miles on it for the price of $8,500, with the additional $500 dollars coming as a cash down payment. It was in the middle of winter and I was not able to get to my doctors appointments because of my vehicle being Front Wheel Drive.  With that desperation I still needed a better vehicle and was expecting the general maintenance and safety items to be taken care of.  Nothing was inspected for safety nor was anything replaced. The as-is warranty doesnt cover any mechanical issues, but the mechanical issues need to be addressed before the vehicle is sold. This vehicle is not road worthy or safe. I am in fear for my life everyday I drive this vehicle and have no other choice. So far I have spent $700.00 and have projected another $1000-3000 to make the vehicle road safe and operable. As far as the rust and corrosion, not sure how to replace a frame or chassis.

    I am rejecting this response because: I am not able to upload images to BBB complaint form website. The files at 640x360 say that the images are, "too large". I have proof of FRAUD on behalf of Victory Motors. The back frame of the vehicle they sold me is breaking off. The car is not street legal let alone safe. I am 65 and handicap and cannot ****** down on the ground to look under the vehicle. If BBB would like to step in or have me drive to their location to provide documentation or an alternative email where large picture documents are upload-able I can gladly do this. If BBB is not interest and is on the same page with victory, I have a lawyer waiting for my word to file FRAUD charges and possible Attempted Murder Charges. Based on the courts decisions, they will file motions accordingly. I strongly urge Victory Motors to reconsider. This Crooked behavior and business ethic is going to end one way or another, either through humility and humbleness, or through the *************** the choice is yours. Sincerely,
