***** Senecal was recommended to me by the realtor (*******) who sold me my home in ******* at the end of 2022. This new home in ******* had fence with a very small gate, a gate that our ******** Husky dog could easily jump over. We were worried that our dog would frequently escape our yard, but also we were also concerned that she is a natural hunter, and she tries to kill and eat any small animal that enters our back yard. We didn't want our dog in our back yard with several rabbits which are everywhere around our property, or raccoons, or we have even seen a bear on our driveway. When I contacted ***** Senecal I told him we wanted a new, custom made gate for our driveway, and that "puppy pickets" would be a critically important feature of a new, custom-manufactured gate. ***** initially promised March, 2023 delivery but it turns out he wanted most of the $3,281 he quoted paid in advance (so a little delay until we paid almost $3,000 up-front. But after we paid nearly $3,000 up-front for the puppy picket fence, it took ***** to the end of July to deliver (four months after we thought we would get a fence). Then when I was in the country of ****** ***** installed a fence at our house *without* puppy pickets. ***** agreed that we paid for puppy pickets but that he saved $655 by installing a gate without them. I immediately told ***** this was not the gate we had custom ordered, and I instructed ***** to remove the gate in its entirety, and to issue a full refund. ***** replied that in no way would he honor his contract for a puppy picket fence, and he sent us a bill to install this very different gate that we never ordered. We want this gate gone, and our money refunded in full. We never ordered this gate.

Regarding this erroneous complaint by *********

***re are at a minimum 6 items that are completely false.

Being the BBB only gives 30 minutes to respond I cannot address them all individually as I would like.

#1 How does it work when you expect recieving product in March, when you pay for it in April. A custom gate manufactured in ********** & shipped to ******** is out of our control & most definitely would have to be paid in advance, if Standard Gate manufactured gates without payment up front, I'm sure people like you would put them out of business in year one. We had gate in our possession for 24 hours before it was installed, & you stiffed a contractor for their labor. That is the reason you have a Mechanics Lien on your property at ************************************************************************ that will stay in effect.

#2 Mentioning puppy pickets over & over does not mean you requested them. You were given a manufacturers image of gate on April 13th, which is what you paid for. You were also informed on July 23rd after install puppy pickets would have been an "ADDITIONAL" $645.00 there was no savings of $655.00 nice try.

#3 *** * **** that was sent to another Client of ours from **** is laughable. "We didn't show up to do your Landscaping & *lectrical ? I wonder why, I've been doing this type of work long enough to be a good judge of character. I predicted to my crew you were going to stiff us. You sir are a taker.

After expecting delivery of a custom gate with puppy pickets in March, 2023 ***** ********************** finally installed a gate in July, 2023,conveniently when I was in ****** for three months and was therefore not present to see the install.  I had specifically ordered a gate with puppy pickets, had been given a written quote for a custom gate with puppy pickets (the written quote explicitly highlighting that puppy pickets were mandatory),and I had paid 100% of the cost up-front!  Mr. ********************** in his reply says that he could tell that I am a taker.  Let me ask, does a taker pay 100% up front several months in advance?  When I saw a photo showing that a gate I had not ordered had been installed on my property, I immediately demanded that Mr. ********************** remove the gate and issue a full refund.  But Mr. ********************** did the opposite.  He filed a contractors lien against my property for his work to install a gate I had not ordered!  Not only am I out more than $3,000, I can not sell my home without first suing Mr. ********************** to remove the contractors lien!  Mr. ********************** says he never performed the electrical and landscaping work he had promised for my property because he could tell in advance that I am a taker.  Apparently he was wary of a customer who paid thousands of dollars three months in advance, before *any*work whatsoever was done!  Unfortunately, I was in ****** for three months and I incorrectly assumed that landscaping services were being performed at the home as we had agreed.  Only when I returned to ******* did I see that Mr.********************** had taken my money and disappeared for several months.

Dude, Your upfront payment in advance was for your material, you paid for what you ordered. No one is going to extend you any Credit because of who you think you are, and yes sir you are a taker. Pay your bills like Humans do.

You very easily couldve driven to ********** ********** and picked up your own gate yourself, you would been sitting there until July when it was ready to be shipped. No one, I repeat, No one, took your money and hid for three months while you ran away to ******. No one cares or is impressed by your repetitive use of the words ****** or Puppy Pickets. Boulder County ******** verified the intent to file the Mechanics Lien request, and found it valid, and you refused to sign for the certified letters. Therefore, you are the one that is hiding. You stole services from a contractor, us Contractors are a very tight Community. Shame on you.

I am rejecting this response because:

My repetitive use of the word puppy pickets is because I custom ordered a gate precisely because I required puppy pickets. If I had wanted just a standard fence I suppose I could have bought anything at Lowes or ***********  Your Contractor **** was filed with zero chance for my input into a lien drafted by ***** Senecal (and only ***** Senecal; liens are automatically accepted at the filing office). I am a Permanent Resident of ****** and I do not live in ****** for years simply to avoid delivery of **** mail.

      Sincerely,

Well this is interesting. I have seven days to return from Mxico to ******* to dig up an actual receipt, or this BBB case will be closed. Since that will not happen (2 days of travel and more than $1,000 in airfare), let me say that the Contractors Lien on my property states implicitly that the gate was 100% paid for. Only the installation cost is and was in question in the Contractors lien (not the cost  paid for the gate!). I have submitted the quote ***** Senecal sent me for puppy pickets and I paid the cost of that quote (3 months in advance).  There is no doubt that puppy pickets were quoted and that the quote was paid. When the gate was installed I was in Mxico.  ***** Senecal never submitted any quote that did not include puppy pickets.
