We retained Chesalon Builders, Inc. in April 2022 to rebuild a wildfire victim total loss (residential home) as a general contractor. We signed a retainer agreement (which agreed to a fixed price-per-square-foot rate) and paid $50,000.00 by check. We were later made aware by our lawyer that they entered into this Contract under a dissolved entity, Chesalon Builders, Inc. when in fact they are actively operating as Chesalon Builders Ent. We have strong reason to believe that Chesalon did not hold our funds in a trust, per Colorado law. Chesalon did not pay all of our subcontractors in full, and the subcontractor came after us to pay directly. Chesalon refused to uphold our fixed rate agreement and refused to send a full rebuild contract honoring that rate. Since Chesalon refused to continue with the rebuild, in April 2023 we demanded a refund of our unused funds. Chesalon refused. We retained a lawyer to demand a full accounting of how the funds were spent. Chesalon's response contained about $25,000 in valid invoices, and the remaining amount was fraudulently claimed (with expenses that we know for a fact Chesalon did NOT incur). Based on this information, we believe we are owed a $25,000 refund. We have attempted to contact Chesalon multiple times over the past year via our lawyers, but Chesalon has declined to respond further. Chesalon has also declined to provide the contact information for their lawyer.
