      I bought a 60x42 pole barn that I put $57000 down on in July 2021. I was promised that it would be done in September. They didn’t get started till the end of September, the company they sub contracted to build the building never built one before. The building is leaning over three inches from top to bottom from the north to south. I called and tried to get the owner to come out and look at the work. She called me a liar so I paid an engineer $500 to come and inspect the building and the engineer said that the building goes against code and isn’t safe. The company finally came out here after the engineer report and acknowledged the building wasn’t built right. It’s out of line, out of plum, out of level and the majority of the Tin work on the outside of the building wasn’t installed right. They said they would rebuild the building but use the same people who couldn’t build it right in the first place. It’s been three months now and now one has done any work. They company won’t call Me back and I have several lawyers who want to sue them but I just want to get my money back now and figured this would be the best path to take first. The building is uninsurable from what several insurance agency’s have said.

      I told Mr. ******, that we would make right, all that was wrong. He threatened lawsuit, and going to court, at the point the subcontractor, went to his lawyer, and we were at a standstill.  I lost my dad in December 1st, so December, was lost to me. I did talk to ******, and he was agreeable that we could discuss getting things fixed.

      Here is the last email of hers on February 18 now saying they would be out next week. So she said they would come out in November, December, January and February and now im at the point that I don’t see and end to any of this and I want to restart the dispute, im asking for all my money back, and for them to come and take down the building plus they owe me the $500 for the engineering report as well. One can only put up with so many lies and it’s a pretty big red flag she can’t even get her sub contractor to come back out here to go over things with me or even with her.

      I am rejecting this response because:both parties were notified of ************ defect in mid October. It’s now been 5 months and I still haven’t spoken with Sito’s insurance company or seen one adjuster show up out here. This building was promised to be done in September. I’ve been waiting a bit too patiently trying to be nice. This is honestly the most unethical business practices I have ever seen or heard of in my entire life and I don’t want anyone else in the world to have to go through what I’ve been having to deal  with it’s not fair and honestly I don’t think it’s legal to hire a contractor with $5000 insurance to build a $63,000 shop/house. I want to get my life back on track so I need to get this resolved ASAP they have had plenty of time to try and fix this issue so please continue the complaint until we can get this issue resolved and we can all go about our lives.

      I am rejecting this response because:Lana you guys never even tarped the doors shut. With winds that high and an open entrance of 14x14 and 10x10 that creates a wind sock in the building and puts tremendous forces inside the building that would have never happened if the doors were tarped shut. I’ve driven by three different pole barns lately and every single one is tarped shut. You admitting that this building has undergone extreme weather without that building enclosed actually puts things at more of a risk than they already are. This building was leaning 3 inches over but most likely it’s even more now! I think your trying to prolong things right now. I’ve spoken with ****** ************ insurance weeks ago now, why hasn’t your insurance company contacted me? You said it was an insurance issue in November. Your a liar, Randy’s insurance company said the claim started a week before they called me two weeks ago. What exactly were you guys doing for the last 5 months? I’m losing money each day and if this goes to court then you prolonging things is only gonna cost you more in the end.

      Better Business Bureau: I think this offer was very unprofessional. You guys literally did nothing but waste my time since I started this complaint. This building isn’t safe, it’s not insurable, you guys saw the structural engineer report and chose to  ignore it. You guys obviously don’t care about safety, and the fact that your allowing contractors to do work like this with no repercussions is honestly pathetic! I’m waiting for the state attorney general to call me back and I will be making a formal complaint about how the bbb handled this situation. 

      I have decided NOT to participate in Binding Arbitration to resolve my complaint with ID ********. I understand that because I have decided to not pursue arbitration that BBB will close my complaint.
