Messer Painting was hired by our builder to paint most of our house during construction. We have thousands of dollars of large timbers on the outside of our home and Messer was instructed to stain the timbers the same color as the timbers on two other homes in the neighborhood (a medium brown stain). My husband and I were present two times as our builder instructed the painters to stain the timbers so I know that he instructed them correctly. Our timbers were stained BLACK as night! Unless the wood was sanded, it was impossible to fix as the timbers are rough sewn wood. As if that was not bad enough, the owner refused to admit that the stain was incorrect and insisted that it was the same stain. ***** is not the same as BLACK! I have pictures showing our BLACK timbers and the other homes BROWN timbers. It is the same wood and anyone can see the colors are not the same. When we finally got over the initial shock of that huge mistake, we asked for a discount at least on the bill and he refused, insisting that the stain was correct. I spoke to him personally and he refused to take any responsibility for this huge mistake. He claimed that he has receipts showing that the stain was the same as the other two homes. When I told him I would like to see the receipts, he said he would not show them to me and hung up on me. The pictures attached are the timbers at our house and the one picture that is obviously brown, is the picture of the timbers at the home that ours were supposed to be like.Initial Complaint

We contracted Messer Painting to paint the interior of our house in July. The contract stated that all interior areas of the house (ceilings, walls, doors, trim, and plantation shutters) would be prepped, and painted with 2 coats of paint. The house was empty when the painting occurred. After the job was completed early 8/2021 we immediately reported to our contact, **** issues with peeling paint, missed painted areas, globbing/ paint splatter on wood ************* ******* discrepancy in a room we requested to pay to be repainted. ****** sent out a non-English speaking painter to paint bathroom cabinets, repaint solo room, to do damage clean up, and repair paint peeling. Painting happened, correction of paint spills, peeling, etc. DID NOT. We moved into the house in late 10/2021 in 11/2021 we noticed increased peeling of paint on all trim areas, doors, shutters, and that the original wall color could be seen coming through newly painted walls and ceilings in all areas of the house. Clearly, 1 coat of paint had been used NOT 2 as stated in the contract. I contacted **** on 12/21, who said he'd send his team to correct the repairs after the new yr. He requested for me to text what needed to be repaired, which I did. He then offered to send a team out during winter storm 1/2022. I agreed and inquired if the team was vaccinated for COVID, I'm highly immunocompromised & hadn't received a booster yet. He said they were not. I requested that they come later in the yr when I was able to open windows for ventilation & had received my booster; I was immunocompromised waiting for surgery. He agreed to my request. When I contacted him on 3/2022 to make an appt for his team to do the repairs he said he'd have them made, he texted that he talked to his boss and they were not going to come out as he promised. he now stated that the issue was with surface contaminants, so it was not his issue. two coats of paint were not used, we were overcharged, and he did not come as promised.
