      7/3/23 M Hardesty Owner of Ridge Run 3 signed a contract with Todd Proffit & Christine Pearson of Jace Mgmt (see attachment “signed contract”). $18,352.62 was wired to Jace (see attachment “outgoing confirmation”). 7/17/23 work began. Jace only preformed item #1 on the contract. He immediately began sending long job notes & change order request more money(see a sample attachment “week 2 report & SOW”) He has sent around 50 long rambling documents about change orders, calculations. He was trying to confuse & make it hard for us if we planned to get an attorney because of the complexity of all the documents. Around 7/31 the laborers, Jace & owners had a meeting. We discovered that Jace has not paid his contractors who are threatening a mechanics lien. Jace did not haul off the rubble or set forms to pour concrete for a pool deck as described in his contract. He has left us to find some to haul off a dump truck load of rubble (see pic of rubble) & another contactor to do the flat work on the pool deck. In the document (Contractor stmt to quit) T Proffit states he prefers to quit and move on. The owners sent a demand letter (see document labeled 3 demand letters) to either continue and finish the job or give us back the prorated funds of the work that was not done. Todd of Jace management stated that he could not pay the workers or complete the work because he spent all the money. We are concerned for him to do any further work as we are afraid of other workers not getting paid and filing additional liens. He continues to send daily harassing letters. We are filing a police report on 8/8/23. We are afraid of him. I think he might be dangerous. Christine had her Appraiser & Real Estate license revoked & also BBB complaint. (See attachments on Christine) We have requested $14,240.12 back from the deposit we paid. We are getting an atty and going to the Atty General. As of today he is considered to have abandon the job. He has committee Fraud.

      We have provided more than 2 weeks as per contract for them to request a mediator and to stop lying about making statements and our communications 
      Blatant lying stating they never approved the change order 
      Plus
      Stating I don’t pay subs- pay them more than anyone in this valley and more often than any and all to a man in this valley and that’s proven, witnesses and confirmed by a dozen parties today! They were not only paid in full for the original contract but over $1000 towards the change order approved and stated we would be taken care of…….but that turned into. “I never approved that” another blatent lie. We won’t start work until approved for one. Secondly we are contracted and regardless of what lies are told the mediator is the solution outlined in the contract
      They were reminded and provided documents every day which they have reviewed almost every day according to our truthful tracking system they cannot hide from!  
      The comment that Christine is committing fraud about stating she works at alpine bank- another slanderous action made by these two sisters and their son 
      Slanderous comments that I am trying to confuse them with information!  —-this is a classic example of the ridiculousness these two are perpetrating along with their kid

      The bottom line is this mediation or arbitration is the only way to solve problems with people that are like this we have been in the business over 30 years. We have only had a couple complaints and with over 1000 projects that’s pretty darn good but the bottom line is there are people like this out there and in order to facilitate a positive resolution, we request mediation or arbitration not only did they refuse this but they use slander, harassment, and aggressive tactics to try to push you down and get their way that is not how we work, and we will not be bullied we will not be slandered, and regardless of the lies detail, we know the truth 

      I hope this provide some clarity and I will be giving you a call as well. Thank you for your time and consideration in this matter and my apologies for the inconvenience.

      But truthfully, we’ve done over 1000 projects developments and have only had praise in the valley. One lady tipped us $1000 for a day worth of work this year, just as an example other businesses we’ve worked with like the all American diner have said that they have anybody any time just give him a call and he would obviously confirm that we’re not only great service providers but we’re always polite, respectful and well priced with high-quality, we provide a warranty and we stand up to our work for anyone to say that we don’t do our work or didn’t do what we said we do is very personal to us as we take that very seriously this is our career. This is our heritage we are fifth generation builders .

      I voluntarily surrendered my ReaL Estate licence as per advice from my attorney, as he stated to do so and go back in one year and reapply, that there should not be a problem to receive it again.

      Due to this action, as per my attorney's surprise (said he had never seen this done before), the Appraisal Board revoked my appraiser license. 

      I had one of the top attorneys in Colorado represent me, and I followed his advice.

      I am able to go back and reapply for both licenses at any time.

      He took it personally and stated that there were several of us on the Western Slope that were long standing brokers that were going through this procedure.

      Coming out of the recession and questionable values were difficult for all of us in these industries and the general public was angry and hit hard financially, hence they wanted higher appraisal values and more money.

      One of the brokers committed suicide after 25 years and good standing, several others quit, and I did not return as I moved forward to avoid the harrassment and bullying as witnessed in this complaint that is the current state of human behavior in which I do not wish to participate in.

      I paid my dues and moved on. I had successful business for many years and in several states prior the recession and no complaints for over 30 years and in good standing.

      Being a real estate broker and an appraiser has nothing to do with Jace Management LLC.

      Hence, trying to throw me to the wolves, and dig up dirt on me is not going to solve the problem, just more elder abuse at me for a long past issue that was over years ago and resolved.

      Debbie, one of the sisters started off by saying can you add 1+1 is two then she had me talk to some Mexican laborers because she said she couldn’t communicate with them so I spoke to them and then it turns out she speaks Spanish. She claimed that Kristine 75 year old bookkeeper, was committing fraud because she sent wiring information as requested from AlpineBank

      Alpine banks agents were told of the slander, the statements about her faking she was a banker or am owner of alpine bank…..Debbie and Michelle and the son of Debbie were all knifing l about committing fraud

      It was harassment and a type of bullying….. all I can say is that they are just plain mean and there’s nothing you can do to absolve them of their character flaws .
      They stated that I had committed fraud somehow when in the contract, it clearly states if there is any issue that you would hire a mediator within seven days. I have witnesses that before I was hired they asked me if there was anything else that would come up and I told them whatever’s underneath the brick cannot be assessed until we remove the brick and take another assessment!

      when this was done I reflected to Debbie what it was and I wrote a letter and she stated that she did not want it done so I commented it without doing that part, the quality in our warranty would not be available. She then asked me to meet her go over it again and she told me she wanted it done she confirmed this twice so to now lie and say that this was not her intent would be beyond ridiculous.

      After all she watched for days as the guys removed the second layer, which was a change order, if she did not want that removed not only would she have not made those comments to remove it, but she also would’ve stopped us before we started removing the second layer , the first layer was paid for and as per estimate it was documented the daily summaries reflect exactly what was done daily and how the days went and who worked they are not perfect as I talking to my phone like I’m doing now because I work 16 to 18 hours a day but the bottom line is it was English and you could read it  nobody else has  complained, we have been praised but no complaints. they called our references and verified this to me the first day

      They know how well were respected in the community, so all of this is just bizarre. 

      when they ignore the change order invoices

      when it says right on the contract, that everything is due and payable upon submission it is not a net 30 is not a net 10 is not a net 2, it is due that day they refused to pay and lied about requesting the change order and therefore they broke the contract why not only committing and trying to defraud us, but trying to extort services without payment regarding anything else all of the items have been documented in the comment that we provide too much information there again shows the type of character we are dealing with when you can’t beat them you just keep telling lies apparently these are two of the most hateful people I’ve ever met in my life and I can honestly say I am shocked at how they treated Christine and myself. Needless to say they have broken the contract in various ways non-payment being the first of many are legal is following up and this will likely be settled in civil court. These two have to be taught that you can’t abuse people in today’s day and age there’s no indentured servitude you can’t strong arm, independent businesses and you can’t just say whatever you feel like saying without repercussions.

This is not how we do business the lack of professional ism is apparent and it is clear that not only has education failed these two if you read their narrative, it’s clear that they probably didn’t get through high school, so I don’t think I can communicate with them regardless , I have tried numerous times.

      I was happy to finish the project if we would’ve been paid in full as per contract, if there is any issue with the contract as with almost every business in the world and what the judge will order is mediation or arbitration. I’m saying this for the final time I probably repeat it now two dozen times and it’s on the contract. I will leave this there and move on since they have no intention of paying us or the subs

      I am rejecting this response.  I would like a refund. It boils down to the fact that he abandon the job and did not pay his labor. Unless they have been paid recently they are threatening to file a lien.  His rantings are nonsense.

      Dear BBB,

      I am very concerned about this contractor. He seems unstable.  I am not going to be satisfied short of getting my money back. He stole $18,000 from me and my sister.  He abandon the job and did not pay his laborers.  The laborers are threatening to file a lien. If they do that I will be out another $4000.  I have back up to prove it. How long does this back and forth go on?  This is a waste of my time.  How do we get resolution?

      I will also upload 4 photos of the piles of rubble that we paid him to haul off that he strewn across our yard that will probably kill our trees due soil compaction.  We had to have a different contractor remove it. There were at least 4 piles. These photos are of different piles. They are not various angles of the same pile.  If you refer to the contract he only got through part of number 1 before he started demanding more money.  He has $18,000 which is well beyond what he states we owed.  We did not ask him to do extra work. So I don't understand all the talk of the change orders.  He said there was more rubble than expected and we agreed we would pay a little extra on top of the contract.  But we were not going to pay in advance.  He never did the work so the change order became a mute point.

      I have decided NOT to participate in Binding Arbitration to resolve my complaint with ID 20432687. I understand that because I have decided to not pursue arbitration that BBB will close my complaint.
