      October 2022 we bought a brand new ***** from ******* ***** in ********** ******* and they told us there was a paint protector on the car and we had no option but to purchase it and then if anything should happen to the car even if we spilled something on it or damage it ourselves, our car paint would be taken care of. January 2024 our car was parked in a parking garage. There was heavy rain that mixed with hard water from the parking garage and it stained our car. It looked like bird poop all over the side of the car that wouldn’t wash off. I brought it to ***** to look at it. Their service manager said it would be protected under the protection plan. His name is Damien T***** and he gave me the number of the warranty company and I filed a claim. The company Simoniz glass refused to even look at our car to fix the problem. They told me they only repair hard water stains, or bird poop. I told them the stain is a hard water stain from the parking garage and he said oh we don’t cover that kind of hard water. They refused to even look at the car. ***** will not call us back and they have been giving us the runaround. My husband did a little research and We ended up fixing it ourselves with a household hard water remover cleaner product that cost under $10 We want the $1750. that we paid for this bogus warranty protection plan back, I can’t help to think how many people have been or will be scammed by this bogus protection plan. ***** is also to blame because they told us we had no option but to buy this protection plan that all new cars come with it and Mazda’s financial manager said if something happens, we will be thankful that we have the warranty. This is a total scam. The ***** dealership we dealt with is ******* ***** at **** ** ******* ***** *********** ** ******

      We reviewed the complaint and cannot speak to what the dealer may have told the consumer. We can however state that the warranty does not cover concrete damage from a parking lot as it is very corrosive to a cars paint. My recommendation is for the consumer to contact the garage owner for reimbursement of any damage it caused to the vehicle as many parking garages carry coverage for just this kind of damage.

      Our warranty specifically states what we cover:

      *********® EXTERIOR PAINT LIMITED PRODUCT WARRANTY:

      WHAT WE COVER: Factory painted surfaces treated with ********* that are damaged by weather induced acid rain, bird droppings, tree sap, insects (including love bugs, Plecia nearctica), aerosol spray paint, hard water spots, accidental paint over spray from newly painted road lines, road de-icing materials and exposure to the sun causing fading, chalking, loss of gloss. All other causes of damage to painted surfaces are excluded.

      WHAT WE DO NOT COVER: (A) Damage caused by stone abrasions, fire, theft, objects striking a vehicle, impact or collision damage, vandalism (excluding spray paint), rust or surface rust, chipping, neglect or abuse, or damage sustained during misuse of the vehicle; (B) flaking, cracking or separating of paint; (C) untreated, repaired or repainted parts; (D) damage due to paint defects which may be identified in a manufacturers technical bulletin regarding materials and workmanship during manufacture, written recall notice, policies or settlements; (E) any parts, decals or equipment installed after the above disclosed vehicle has left the factory assembly line; (F) damage to any metal plated or chrome trim; (G) any damage to the truck bed floor panel, or damage to the paint on the panels or tailgate of the truck bed facing the inside of the bed; and (H) damage to any surface not treated or treatable with Simoniz® *********®.

      Also our warranty is a “Product Warranty” so the product has been applied to the vehicle and cannot be removed. However if the consumer is looking for a refund they will need to speak to the dealership and see if they would be willing to do this as the transaction is between the dealer and the consumer.

      Purchased the GlassCoat exterior / interior protection policy with my next 2021 **** ******** warranted by the Simoniz, ***** ******* ********* *** in ******* **. The carpet in the rear storage area was stained and a resultant odor is present when a cosmetic case containing make-up and hairspray spilled. A claim was filed per the policy directives. However the claim is being denied. The company states that "hairspray", which is a cosmetic, is "not covered". Despite my Attorney reviewing the policy and confirming that this stain according to the contract is "covered" they continue to deny coverage. I am including for your review a copy of the contract, the communication with the below individual, and the estimate for repair from the auto dealership.
