On 9/22/2022 we accepted a quote for $3,900 from Paving Services to pave over part of our driveway, to cover some potholes. On 9/28/2022 the work was carried out and the contractor was paid in full on completion, as per the signed agreement. The work was done while I was on leave and on my return on the week of 10/10/2022 I was asked to follow up with the contractor as the edges of the resurfaced area were not feathered or tapered to the level of the pre-existing paving. The following week, our snow plow contractor, who was surprised that the resurfacing was left that way, confirmed that the lip of 1.5 inches or so around the margin of the repaved area will create issues when the driveway is next plowed, as the plow will catch the rim and ultimately crumble and damage the new paving. I subsequently contacted William, the contractor, who on hearing our concern said that we would have to pay him extra in order for him to fix it as he wouldn't do it for free. On 10/26/2022, the director and owner of the business called William to try to negotiate and come to some sort of agreement. During the brief conversation William refused to listen, was hostile and aggressive, talked over the owner who was speaking calmly, and proceeded to hang up.Business response

When paving over existing pavement it will not be the same level as the existing pavement. In order to have it completely flushed you’d need to do a full driveway replacement. If you want it to be as flushed as possible we would need to do a saw cut to lower the elevation there, which would be an additional cost.Customer response

I am rejecting this response because:It is understood that when paving over existing pavement that the resurfaced area will be slightly higher than the existing pavement. While we were not expecting the resurfaced area to be completely level with the rest of the parking area, we were expecting feathering along the seams or at least some degree of tapering along the edges to minimize the obvious “step” that now exists between the two levels. When discussing the proposal with me, at no time did the contractor advise that a significant lip would be left along the edges of the apron. When we consulted the opinion of at least two other tradesmen they were surprised the job was left that way. As explained in the complaint details, without this issue being addressed, come the first snow that requires our driveway to be plowed we fully expect the newly repaved area will be significantly damaged and money spent will have been wasted.

I’m sorry for the confusion, but an inch wouldn’t be considered a “step”. They are patches, patches are not meant for longevity, it is a temporary fix. Like if you’d patch a tire, you would need to replace it eventually. Same goes with asphalt, a patch is a temporary fix to hold you over until you get your driveway replaced. I’d be happy to try to get it more flushed, but it would be an additional cost, since we’d need to do saw cuts. Also, plows ruin driveways all the time, it’s part of living in areas with harsh weather conditions. The patch will not be completely removed when the plow goes over it, it may get a little damaged where the new asphalt meets the old asphalt, which is completely expected.Customer response

I am rejecting this response because:The fact that plows often damage driveways is irrelevant. This job was finished in such a way that plowing will almost certainly cause damage to the asphalt repair and possibly to the plow itself given the difference in height between the patch and the surrounding paving. We appreciate that you can fix this, but we should not have to pay extra to get the job done right. We expect it to be fixed at no extra charge, or to be reimbursed for the extra charge we will incur for another contractor to finish the job correctly.

Another paving contractor was hired to fix the issue. Contrary to the original contractor’s insistence, no saw cuts were required. The new contractor ground the edges down thereby removing the excess asphalt and tapered the new paving to the pre-existing level, which is all that we had asked for. The job was completed quickly, efficiently and finally done correctly.

This company dumped leftover asphalt in my driveway without my permission. My driveway currently has asphalt in it that I never requested or purchased. It’s crumbing causing damage to my yard, driveway, and sidewalk. The business owner has been contacted on numerous occasions and the problem has not been resolvedBusiness response

Complaint has been resolved. We went back and fixed problem area
And removed all old asphalt. Customer is now happy.
