      Business was hired to remodel Bathroom, kitchen and change 5 radiator heaters. All quoted at about 23,491 dollars out of the total amount due 19,700 dollars has been paid to the contracting company. (I have receipts of payments dated from Feb-March 2024). The contractor has not completed the job, nor bough all the materials needed to complete the job, he turned off his cell phone and continues to say he will refund partial amount but continues to push the date of refund. We also missed the timeline of completion and he stopped all his efforts to work on the project at hand and has no intention of returning. I now have to hire separate company to finish the work as I am on a tight timeline accruing fees with other contractors and tenants. Tenants also cannot live in apartment as its still in construction. No kitchen nor bathroom available and has not been available for 1-2 months and still counting. Pictures and receipts attached. Contractor has also broken a brand new window, 1 ceiling light, and 1 fog light and 1 electrical wire connection to the 2nd floor he never installed not included on values paid/quote values. Radiators replacement was also paid but never given receipt (2500 usd cost). Contractor proceeded to erase the quote from portal used to hide the work he agreed upon to do on the property and any amounts received.

      I agree job is not completed and  i did not abandon the contract. I was advice to not return because i was not wanted on property and to give them time to cool down although i did not understand what went wrong. I also have all receipts. I gave customer copies. All numbers are in sync with the customers. I agree on the heater cost the customer had a sudden cancellation and have started the refund process. As to materials. I had a person mentoring me because this was my first contract and i needed guidance but seems like i was following the wrong steps. that person was inputting the order. My phone was not off. I answer emergency call therefore i cannot have it off. It's possible that the reception was not good as i was in hospital handling an emergency situation. I agree on the broken window. Tried to remove carefully and it shattered. I agree that i must be held responsible for that. I was not aware of the broken lights. Was not informed. As to the contract being erased from portal. It was erased. The quoting system i was using was not working well for me and i switch over to another system. Upon transferring the contract to the new system, it erased. I did not do it correctly and i do indeed have the contract on hand on paper.  The crew and mentor that was working with me are still on property completing the work and also using my equipment. I feel this is personal towards me which affects my company. I have been made out to be a bad person almost as if i was working a scam. I left a great pay job to start my career and start from the bottom. Even if i wanted to scam i wouldn't know how to because that's not who i am and the customer should know that because we are/were friends and know me better than that. The reason i am responding to this complaint is because I want to resolve this as it takes a toll on my family and also a bad start to my business. This is a failure for me and also a lesson learned as a new business owner and hope this don't ruin my future work.

      I am rejecting this response because:

      Business its not identifying or agreeing to remediation. Business abandoned job since owner was only present 5 days at most mostly to collect money amounts to try to have jobs reach 100% pay and cause damages onto property. He was removing work from quote to remove added costs and collect as much profit as possible. He did not pay the workers which he owes one for this job 3000 usd, and the other 4500 usd. He was fully aware of all broken windows and lights as they were shown to him and almost caused a short circuit with water damage. He also agreed he erased contracts from portal. His crew is no longer with him because he did not pay them and took all of the profits from the projects. I have to pay another business to finish all of the work as the business IR property did not complete nearly anything from both projects. The owner also took his tools from property a day after I started this BBB complaint. If the business owner wants to close out this complaint have him subtract from the 19400 usd paid to him the costs of materials from using dated receipts of the job and refund the remaining amount. As he mostly used the profits and costs of the projects to himself leaving behind unpaid workers and for me uncompleted jobs with tenants unable to return to their property. IR buisness worked at the property for at most a couple of days. another business to this date is still working on fixing the issues IR property has left. (having to double pay for contracts which were almost paid in full).

      It was mentioned that i took all the profits for me and that's incorrect. As to the employees im not sure where that amount came from. I've actually taking care one of the employee in full and the other had an agreement. Yes, i did admit contract being deleted and not on purpose. Again, the contract is in my paper file. About the broken light yes its true. The plumbing did not seal correctly and wet the light fixture. I admit that. I did have worker pick up a table saw but remaining tools were left behind. Refunds have been getting paid as much as i could. How much refund was the customer  seeking toward material? I feel i was set up for failure and i want to settle this. This is and will continue to stop me from supplying to my family. I was not in this alone as i was being mentored on every step and i understand regardless as owner i am responsible. While worker was on site i was out searching for more work, bidding and studying. I also do handyman and emergency calls and therefore i had a person on site overlooking the project. As my first contract it obvious i didn't know how and correct steps to take and this is once again a lesson learned. I have not scammed or planned on this contract to go wrong at all. I don't seek to find ways to ruin what i want for my future for myself and family but to find solutions. So, what's the next step?

      I am rejecting this response because:

      individual Was given a total of 19600 usd to finish both bathroom and kitchen thus far. I am requesting business subtracts what was used in materials using paper trail receipts and returns the rest. He has only refunded 1450 usd and has not done any of the work and only paid a worker of his that was his own family member. The other two workers are still owed 3000 and 4500 respectively. The owner of the business has not worked at the property and should not receive any of the profits. I am having to pay separate business to finish the job thus paying for these projects twice. I Can provide receipts if requested. Have the business owner set up a payment plan or use his insurance if he has spent all of the money provided to him. Also the remaining tools at the house are from a different company and not his own. He has left no tools inside this property. That day the business owner found out I filed this report he asked his family member to get his tools and advised all to stop working on the project. In addition, Material cost at most do not exceed 6000. Have him deduct material cost and refund the rest. My case is if the job was not worked at the staff not paid, the work not done, materials incomplete, what did he spend the 19600 usd on. If the business owner does not pay or stops his payments plan, I will escalate this matter to civil court and department of consumer protection.
