      On April 15, 2024 I went to Whaling City **** in *** ****** ** to purchase an **** to haul cows and my tractor to the different properties I work with. I had been working with a salesman, Kris B****, and my 1 need for the truck was that it needed to be able to haul 10k pounds since my tractor weighs 4500lbs and the trailer I need to haul it weighs 3500 pounds bringing me up to 8k lbs without any other attachments. I did a lot of research when shopping for this truck and when we sat down to discuss moving forward with the purchase I pushed back on the truck because I didn't think it was capable of towing what I needed because of the differential gearing. Kris looked up something on line and assured me that it was indeed capable of towing what I needed. We went through with the purchase and I drove down to ** to get my tractor from my parents property. I went to purchase a trailer while in ** and the salesman informed me that my truck was not rated for the trailer I needed to tow my tractor. I did not believe his assessment, even though he looked at the door sticker and punched info into his computer. I then called **** Motor Company to see what they had to say, just to find out that my truck was not able to tow 10k but 6klbs. I immediately began to try and work with the dealership to figure out a path forward since the one thing I needed in the truck was not sold to me and I was actually steered away from what I needed just to make a sale on a truck that was last years model. I haven't made a single payment on my vehicle yet and made an attempt in person (after talking with the ** and owner) to figure out a path forward. I was offered $40K for a truck I paid over $51K on not even a month prior. I asked to speak with the **/Owner (who is the same person) and was refused. I was told that that is all he was willing to do and would not be speaking with me. I was also told that I should have done my research before purchasing even though I did and was assured I was wrong

      To whom it may concern,

       

      In regards to *** ***** having the wrong truck to fit his towing needs. We would like to help him out of his present truck and into a new one. *** *****

      Stated he paid over $51,000.00 for his new truck. In fact *** ***** paid $51,104.76. That amount included $46,771.61 which is the original purchase

      Price of the truck. Then you add sales tax of $3,191.55. *** ***** also purchased a service contract for $3,389.00. After you add registration and

      Dealer fees you get to his total of just over $51,000.00. If we gave *** ***** $40,000.00 for his present truck he would also receive a sales tax savings

      Of $2,540.00. for trading in his vehicle. In addition *** ***** can cancel his service contract and receive a prorated rebate. We are not sure where the

      Confusion came from with all the research that was put into the purchase. We would like to help *** ***** get the vehicle that fits his needs.

      Whaling city has had my truck for three different attempts to fix the problem keeping my truck for almost the entire summer and now going into the fall trying to fix the same problem the truck is under warranty they will not provide a vehicle for me to drive or give me any idea when my truck will be fixed two times now they've sent it home claiming it was fixed all they did was clear the codes what's the point of a warranty if they don't honor it

      Unfortunately, Whaling City has ignored multiple phone calls and emails requesting my $368 refund for the balance of new vehicle registration fees (I was an out-out-state buyer). The finance person disputed the official published fee schedule information then stated it was not relevant as I would be refunded the difference. Even after contacting the owners, it’s now been almost 4 weeks since I took delivery and expect they will never refund me. Based on my experience, I would say Whaling City is a “stealership”.

      We are always keeping up with any issues as we did with this customer. The customer was told multiple times about our policy and the costs to complete an out of state registration. The business manager not only goes over this verbally but we have signs posted in the business office where all transactions are completed. Please feel free to contact me anytime.       I am rejecting this response because: I’m disputing the cost of the registration fee. The business manager specifically explained that the balance of the $503 deposit would be refunded based on the actual registration and title application fee. I also noted that the *** fee ************* was $75 for the *** and $25 for a plate transfer. The business manager said “don’t worry, that will be refunded”. I have a witness (my wife) and contemporaneous notes to confirm that was stated by the business manager. I also have a written “offer agreement “ where I added a note indicating that the registration fee was a deposit subject to a refund. I specifically signed that offer with that stipulation because knew the registration fees in ************* were well below the $503 deposit. 

      I have explained these circumstances to the owners (via email) and based on their response to my BBB complaint, they are clearly acting in bad faith by not abiding to the agreed upon business terms for getting a motor vehicle registration in *************. 


      if this matter in not quickly resolved through the BBB, I will be forced to seek the appropriate fair and just relief through a legal action.
