My wife, ******* ******, and I agreed to LGE's $7,800 home driveway improvement "proposal" on May 14, 2023. No formal contract was provided. The project did not begin until June 6, 2023, 23 days after the proposal was accepted, when LGE removed the existing driveway and applied new fill. We provided Mr. G******* with a check for $3,900 on June 7, 2023. He deposited the check on June 8, 2023. Mr. G******* advised us that the new fill had to sit for one week before the asphalt was applied and the project completed. However, LGE did not return in a week, prompting my wife to email and call Mr. G******* to determine when the job would be continued. I called him on or about June 21 and left a voicemail but he did not return the call. Finally, on June 22, Mr. G******* responded in an email to my wife that the company's truck broke down and that LGE would return on June 26. LGE finally returned on June 26, to install the asphalt during light rain. We paid LGE another $3,900 on that day and the check was deposited the same day. The new driveway is defective. After phone calls and emails inquiring about the work, Mr. G******* agreed to take a look at the driveway on July 7 between 9 and 9:15 a.m. but he did not appear. Other paving contractors have assessed the driveway. They have stated the asphalt is "rough" looking and the stone aggregate mix appears to be laid thin (less than three inches). One contractor questioned whether the asphalt was cold before it was rolled out. The driveway has pockets of stones throughout and the paving lines are visible and not smoothed out. There is a question as to the amount of fill that was used as there are uneven spots. There is also puddling in the driveway during rain. The resolution, per the contractors, is to rip up and remove the asphalt, assess the need for more fill and then reapply three inches of asphalt in an even and smooth manner, eliminating any undulations, visible stones and rough lines.
