  On August 2, 2022, SKJ Tree Service arrived at ** ******* **** to remove a large tree in my yard. I discussed the access options with Seth M*****, the owner of SKJ Tree Service, during our initial meeting before signing a contract. Seth acknowledged that the ramp between my two retaining walls was narrow. He told me that the tree chipper would not fit, and he would find alternate access or carry the cut tree branches to the chipper. Seth and his crew arrived on August 2, 2022, and attempted to back the truck and chipper through the narrow ramp. Seth and his team are responsible for extensive damage to my two retaining walls. They left my house without informing me of the damage. I texted the estimate of $850.00 for the repair of the walls provided by the contractor that will rebuild the damaged wall area. I emailed and called Seth several times to resolve the matter. My most recent call was on August 19, 2022. I left a message indicating my willingness to negotiate. He has not returned my call.

  I have returned his calls and lots of emails. We are and are willing to assist. We simply asked for a breakdown of the contractors bill. I did believe the quote was high for the amount of damage. As far as not allowing us to use property he needs to check his signed contract. We did not back the truck in either. It was driven in. So there is not a lot of truth with **** in this matter. With all the bad mouthing he is doing I’m begining to not want work with him. Iv exhausted my options with him as all he had to do was provide me with a written quote on the repairs. But failed to do so. I even wanted my contractor to have a look but he did not like this option. At this point like I said before iv exhausted my options with ****.

  I am rejecting this response because:

  Mr. M***** comments on the position of the truck entry into my yard. The method of entry is irrelevant. SKJ Tree Service is responsible for the damage incurred to two retaining walls on the property location of ** ******* ****, ****** *********** on the morning of August 02,2022. Said contractor was granted access, permission to the property of ** ******* ****. Access permission does not preclude the right to incur damage to the property without due recompense for above stated property location. I emailed a detailed work order from my contractor, Ladscapes with the cost estimate of $850.00 for repairing the two retaining walls. The relevant facts, and pertaining to *********** Law Statutes, is that SKJ caused said damages and is responsible for due recompense. I called Mr. M***** on August 23, 2022, to discuss an equitable, negotiated settlement. Mr. M***** did not return my call.
