      This company has a guy named **** ******* working for them that is not doing his job properly he worked with giggle finance and had a lien put against my Instacart a and doordash accounts and never told me he lied and ascted like he had a lien on my cash app but the whole time it was another company I paid them off back in 2022 and now find out they he has a lien still placed in my accounts 2 years later and when I emailed him to have them released which they should have been released two years ago when I paid my balance. He refuses to send the release saying that “they have to remove it not me” which is false because he has to send them a release to remove it in order for them to remove the lien and I told him that and now he won’t respond to my email. I also would like him and his company reported because he does not deserve to be in this field he lies and take advantage of the peoples situations! He should have been sent the realer to stripe.

      The merchant, ****** **********, was placed for collections in our office by our former client, Giggle Finance. ****** worked with Mr. ******* to come to an amicable settlement solution to resolve her obligation to Giggle Finance concluding on October 20th, 2022. ****** notified Mr. ******* that there was an active UCC-1 lien on her Stripe account, which in turn affected her Instacart and DoorDash accounts. Upon termination of the relationship between Kearns Brinen & Monaghan and Giggle Finance, Kearns Brinen & Monaghan utilized a 3rd party to assist in releasing the active liens on merchant accounts. Confusion arose when it was communicated another company had the lien, in which case the lien enforcer would have to remove the active lien or Giggle Finance would need to furnish a UCC-3 to terminate the lien. In response to the merchant's complaint, Kearns Brinen & Monaghan has submitted a lien release to Stripe to remove any active liens enforced by Kearns Brinen & Monaghan in regard to the satisfied obligation to Giggle Finance. Upon management's attempts at trying to contact Mrs. Saintlouis about the lien on February 20th to gain the full scope of information and find a resolution, we received no response. Kearns Brinen & Monaghan has made an active effort to resolve the complaint as quickly as possible. With all documentation submitted, Stripe will release the lien as soon as they can process this information.

      Better Business Bureau: I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my  issue.  For your reference, details of the offer I reviewed appear below. **In order for the bureau to continue to assist you, you MUST provide your view on the matter or your complaint will be closed as answered. I would like to report this company because **** ******* does not property do complaint in with the BBB after numerous efforts of me contacting **** ******* befor having to contact the BBB , with no help from him. I should not have to go out of my to contact the BBB to get the lien lifted from two years ago that was paid two years ago I don’t like they way this employee conducts buisiness and I do not like the fact that this business just lied stating they contacted me and they very well did nothis job if he is working in this field when the I paid the balance of my dues he should have lifted the lien instead he decided to be rude to me and lie to me in an unprofessional manner his business kbm also made a statement and lied that they contacted me and In fact did not contact me at all. I had to contact them. They only responded when I put a complaint in with the BBB after numerous efforts of me contacting **** ******* befor having to contact the BBB , with no help from him. I should not have to go out of my to contact the BBB to get the lien lifted from two years ago that was paid two years ago I don’t like they way this employee conducts buisiness and I do not like the fact that this business just lied stating they contacted me and they very well did not!       We understand the frustrations of ****** ********** and have worked quickly to comply with her request for it’s removal. Upon receiving the complaint, KBM attempted to contact ****** ********** on February 20th, 2024 regarding the lien on her account and finding a resolution. A screenshot of the call log entry and a copy of the voicemail left by KBM's collections manager, ******* *****, is attached in the zip folder to prove that we did try to contact ****** ********** on the number we had on file. As heard on the recording, the confusion on the account is that this merchant's account had been serviced by another collection agency prior to placement with KBM. If the previous agency had enforced the UCC lien on the Stripe merchant account, KBM would not have the power to remove said lien. In order to help ****** ********** as quickly as possible, our management team reached out to gather more information and clarify the situation. Upon reviewing the information attached to the BBB complaint, our office quickly submitted a lien removal request to Stripe to free the merchant's account. The lien has since been lifted from the merchant account and discipline with the employee involved with this will be handled internally. If there are any other liens affecting this merchant’s account(s) from Kearns Brinen & Monaghan, please reach out to us at [email protected] so we can get them removed as soon as possible. If there are no other liens to be removed, we consider this complaint resolved.
