In September of this month (2021), I hired Pat's Construction LLC in Middletown, Delaware to replace and stain my outside front steps. I also hired them to refinish my iron railings. The company replaced my steps and removed both of my railings in order to finish them off site. I was promised that the railings would be completed the next day and would be replaced. A flimsy temporary wood railing was installed. After about a month, one railing was brought back and partially installed. It is not fully bolted down and is unstable. It has been two months and the company still has not returned and installed my second railing. Additionally, the steps were supposed to have been stained within two months and they have not. I have repeatedly reached out and have received excuses. The temporary railing is very unsafe. I would like my railing refinished, returned, and installed like promised.Business response

We have made her steps from unsafe to solid and sturdy and SAFE. Yes we took *****’s railings down to strip, weld, clean, prime, and paint them off site. We installed a temporary 2x4 railing for safety reasons as required by Delaware Code and OSHA Code. In the picture ***** has provided you can see the 1 iron railing and the temporary railing. Our temporary railing was far from flimsy, it was in fact very solid and sturdy and SAFE. ***** was NEVER promised her railings would be completed the next day after we took them down. The steps as you can see by the picture she provided are pressure treated therefore you cannot paint them right away otherwise the paint will peel right off due to the treatment drying out of the wood. I had stated to ***** that we have to wait at least 6 months before we can paint. I also let her know that I will check them periodically and see if they are dry enough to paint yet. So her steps were NEVER supposed to be painted within 2 months. Once we got the railings to the shop we started work on them and found out that they needed a lot more work due to the legs being completely rotted out, so we had to cut, weld, and grind new leg brackets onto the railings. We messaged ***** and told her how bad they were and that we needed to weld them and that it was going to take a bit longer to do the railings. Before we even took the railings I had told ***** that I can only work on them after work during the week for a few hours a day as I have another full time job. As time went on ***** just couldn’t understand that I work and couldn’t always get to work on the railings every day and weather played a role as well because I could only work on them outside. As of Monday November 22, 2021 I messaged ***** stating that, “At this time it’s best we go our separate ways since we cannot see eye to eye. Don’t worry about the rest of the bill as it is on us. We will have your other railing installed tonight.” Attached are 2 documentation videos of the existing iron railing that we already installed weeks ago and the other unfinished railing installed. I did not take a documentation video of the temporary railing before I took it down, but as my helper as my witness that temporary railing was solid, sturdy, and SAFE as I put all my body weight into it. The video labeled 1968 shows how solid, sturdy, and SAFE the iron railing is even with missing 1 bolt that has since been installed. The video labeled 1969 shows the missing bolt installed and shows still how solid, sturdy, and SAFE the railing was. It also shows the other railing being unfinished and solid, sturdy, and safe except for the bottom because I was unable to weld a new leg bracket on since it’s rotted away. So at this time we are no longer providing our services to ***** and will not be refinishing or painting the railings, or steps at this time. Furthermore, the so called “excuses” that she is stating I gave her when she would reach out to me are far from “excuses” as I kept trying to explain and tell her that her steps are SAFE and that it takes time to do these railings, but she refused to understand. I could provide pictures of just how much work was needed on these railings if need be.

I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my issue. For your reference, details of the offer I reviewed appear below.

I was never told that the contractor could only work on my railings a little at a time or that he worked another full time job. The welding for the rotted part on the railings was only fixed on one railing, not both. And I was told that the steps would be dry enough to be stained within 2 months. I also did not owe any more money for what was already done. I am very disappointed with the service I received and will not recommend this company. The second railing was installed without being completed and it looks terrible. But since I finally have both of my railings, I will not pursue any further action.
