*** from Banning Hardscapes took our deposit for proposed patio project and did not do any work. Attached is the contract dated from May 13th 2022 that describes that project is scheduled to start in August (*** also verbally promised that we will have patio by the end of August) and that *** received $ 4,750.00 of deposit. $ 4,750.00 was taken out of our bank account on May 17th 2023. He was supposed to give us samples of pavers. We have not heard anything from *** for couple of months. Starting in July through September 15th I made 8 contacts with *** to remind him that he still has not given us samples, he made excuses and promised he will get it to us "next week". Finally, on Sept 16th he dropped them off and 2 weeks later we gave him our picks - on October 2nd. Entire month of October *** was giving us one promise after another in regards the start date for the project (which was already delayed by 2 months), giving excuses that he is "waiting to hear from his distributor" how soon he can have the pavers delivered. we gave him couple of notices via text message asking that he please make it happen or we will be asking for our deposit back. He said he will make it happen, however nothing happened, so Nov 1st we asked for our deposit back to which *** responded that he already has pavers and he will need to return pavers back to distributor to give us our money back. Starting November 4th he was giving us fake promises that he will have the check mailed to us "next week". It is now February 20th, 2023 and we saw neither patio nor our money. we lost a year of dealing with this business. To sum up, he deposited our check right away - mid May. We saw zero work done. We trusted him, but he failed on his multiple timing promises, the biggest one being not doing his job at all.
