The problem is related to the reimbursement of a payment made to the **** of America (BoA) that *************************** Associates (P&C) deposited into and a Citibank account related to payments for the Estate of *********************** *****. I am the brother of the deceased, and the personal representative for the ESTATE. The P&C Ref. # is ******** and the Horry County (**) Probate Case number is 2021ES2602638.Facts of the Complaint: 1) In October of ******** deposited a check made out to BoA into a Citibank account. My brother, ********************* had an account with both entities but P&C deposited the BoA check into the Citibank account without informing BoA or I! (see attachment #2 - the front and back of the Oct. 2021 check to BoA); 2) I searched for this payment since ***** Fargo (the bank checking account) indicated the check was received and cashed. In October 2022 (1 year later) finally discovered that P&C had put the funds ($6,988.60) in the wrong account and contacted both Citibank and P&C with each telling me the other entity had to resolve the return of the funds, and neither doing anything to make this happen. I have called both Citibank and P&C and spoke to representatives/supervisors at both institutions, being told since November 9, **** that the check was in process, BUT it has never arrived. In January I was told a new check would be processed, yet 3 weeks later - still no check!3) Everyone is very nice when I call and when I explain the situation and they look it up on their computer, they can see the cancelled check of my payment, the documents sent (attached here - Death certificate for *********************** *****; my authorization by the court as Personal Representative of the estate) promising to resolve the case, agreeing the $6,988.60 is in the closed Citibank account, and that they have no idea how that was incorrectly processed, nor why no one notified me of the funds sitting in a closed account of my brother. I NEED HELP! I have reached an impasse with P&C.
